NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #43

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Im reminded of Mridul Wadhwa’s (know that’s misspelt!) not being a witness in the ERCC case.

I know the Unseen University isn't to everyone's taste but I do like Archchancellor Ridcullys management diagram "me who does the telling.....everyone else" personally I feel my work would go much smoother if they just let me adopt that position 😆

I don't do jam or knit or sew but I do bake and if work didnt take up so much time, I'd do more writing

I really feel for Sandie, it becomes more apparent how alone she must have felt, thank goodness for Neale Harvey connecting her with the right people. The visible change in Sandie in photographs shows the impact of all the support.

At the beginning she must have felt like she was stuck in a nightmare that she just couldn't wake up from.

Imagine if she hadn't thought to go to speak to Neale, it just doesn't bear thinking about.

But somebody must be questioning things from the board level, everyone answers to somebody in this world.

You’d hope but remember the board must have been behind that Friday statement and do demonstrate they don’t hold anything against their lying cheating misogynistic staff for the utter failings that got them here.

Yes to marmalade, crochet, gardening, wild swimming and sewing. I can throw in a bit of dyeing and weaving. Enthusiasm rather than skill is the main feature of my textiles endeavours but I love learning how to do something new.

Whispered confession incoming - I tried Pratchett once as a teenager and didn't like it. But absolutely love Austen so hope not to be completely cast out for heresy.

I agree with starting with the witches, but I'd start with Wyrd Sisters, as Equal Rites suffers a little from early series teething issues. Plus it has a few enjoyable Macbeth references, and means you're only one book away from Witches Abroad, which has a couple of sequences that are guaranteed to make me laugh out loud, no matter how crap a mood I'm in.

It's never too late to start with Discworld, you just need to make sure you start with the right one. Never start at the start with the first book! It's a good novel, but it's a bit clunky and a hard sell for someone on the fence.

My mum was put off for along time by the Kirby cover art which made her think it was "all stupid fantasy non-names and rubbish". I said one of the main characters is called Sam, and gave her a copy of Wyrd Sisters and one of the early Watch books. I love the Watch but I can never tell which book is which.

I created a monster. She ended up devouring all Pratchett, even the non-Discworld. She'd go into charity shops and buy what she could find, even if she already had a copy. You'd know she was reading a Discworld because you'd just hear random bursts of laughter from the kitchen. She ended up ahead of me in reading them and when I asked to borrow one she was very firm in ensuring it was returned, which was a cheek as I never saw my original one back!

Up to a point.

There have been references to the Board being aware of the incident in early January IIRC, but I don't think we've seen a paper trail around it.

I have a suspicion that Jamie Doyle's absence may be an attempt to keep Senior Management and the Board out of the tribunal, as his cross-examination could be telling.

Also his suggestion about a police report for a hate crime - I think it would be unusual for anybody in the public sector to do that without cover from above.

If you look from p145 of these Fife NHS Clinical Governance Board papers, our witness refuser, Head of Nursing, Jamie Doyle is currently responsible for a very lightweight Quality of Care Review process with a powerpoint presentation.

Amongst pages of nothing much, it includes a full page photo of Walt Disney and the quote "The way to get started is to quit talking and begin doing".

Someone on the inside is trolling the Board, Mr Doyle!

TL;DR Jamie Doyle, Head of Nursing, seems to have been a key player in Sandie's trumped up 'patient safety'-related suspension, but has refused to attend the tribunal to give evidence. And the Sandie suspension comes at the end of a year where Mr Doyle has himself been named in a public inquiry around an unexpected death at Victoria Hospital. Miss Russell, advocate represented Fife at that enquiry.

( Are there enough Miss Russell, advocates in the country for that to have been a different one to the SP tribunal? Is Mr Doyle hiding away for any reason? So many questions!)

Not a good look for Jamie Doyle nor NHS Fife. Just when you think that can’t be much more covering up in NHS Fife something else comes along. It just shows that their Head of HR, Mr Miller on over £100k a year, needs to pull his finger out and start earning his keep.

This is true, and Swinney and his i support them shit.
But there must be changes somewhere. SNP must be waking up to what the Be kind really means at the ballot box (lots of people just don't think it through)

oh dear! that should fill the thread nicely.
I've noticed over the years that it is easier to spread cream onto jam than vice versa, as jam on top doesnt stick to cream as you spread, so makes a bit of a mess.

Let’s take Sandie’s word for it that they didn’t occur, not in the manner claimed. She said she never ignored DU in department and would have only asked him to do obvs if she’d been called to another patient.

I vaguely remember her talking about remembering the resus incident cos a kid has been given a Snickers and was allergic to peanuts but I can’t find that in the TT transcripts.

NHSF never thought they had any duty to SP and women who feel like her and they never thought they would be held responsible for this appalling mess they made because they felt they were fully in step with the Scottish government and a large part of the opposition. They absolutely never thought they would have to defend their decisions in front of a court and a very interested public.
