NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #43

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence had been intended to be 28 July with 2 days of submissions from counsel meaning that the hearing was to have ended on 30 July. However, it became apparent as the hearing progressed that this schedule wouldn't be followed.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

On FB it has been said that Jamie Doyle was 'invited' to attend the SP tribunal as a witness but sent a letter from a solicitor saying he didn't have to, and wouldn't attend.

I agree with starting with the witches, but I'd start with Wyrd Sisters, as Equal Rites suffers a little from early series teething issues. Plus it has a few enjoyable Macbeth references, and means you're only one book away from Witches Abroad, which has a couple of sequences that are guaranteed to make me laugh out loud, no matter how crap a mood I'm in.

@FlirtsWithRhinos I wouldn't have said that post was a screed, but even if it was, all would be forgiven for the introduction of the Dr Update moniker .

If you look from p145 of these Fife NHS Clinical Governance Board papers, our witness refuser, Head of Nursing, Jamie Doyle is currently responsible for a very lightweight Quality of Care Review process with a powerpoint presentation.

Amongst pages of nothing much, it includes a full page photo of Walt Disney and the quote "The way to get started is to quit talking and begin doing".

Someone on the inside is trolling the Board, Mr Doyle!

TL;DR Jamie Doyle, Head of Nursing, seems to have been a key player in Sandie's trumped up 'patient safety'-related suspension, but has refused to attend the tribunal to give evidence. And the Sandie suspension comes at the end of a year where Mr Doyle has himself been named in a public inquiry around an unexpected death at Victoria Hospital. Miss Russell, advocate represented Fife at that enquiry.

( Are there enough Miss Russell, advocates in the country for that to have been a different one to the SP tribunal? Is Mr Doyle hiding away for any reason? So many questions!)

The graphic novel of Mort helped me learn English.🙂Oddly I read the graphic novel, then the play adaption and tackled the book after, moving on to the other Death centred ones.

I have never met anyone else who had Mort as their first introduction.

I've seen the comments about Cherry being trans before and found it a bit baffling. I get your point about people reading into things different ways but it always seemed clear to me that it wasn't about females transitioning from being males but about female dwarves challenging the idea of male as default (along the lines of Invisible Women) There's a quote somewhere in one of the Guards books along the lines of 'dwarves knew there were female dwarves, they had mothers after all, but as long as they weren't too explicit about it'.

Same with Monsterous Regiment. I've seen the women in that described as trans, when they were women forced to imitate men in order to escape variously sexual abuse, a way out of a limiting life, to be able to follow their lover into the army, a way to find a brother etc etc. But these women never thought they were men. As Jackrum says "Upon my oath I am not a shouty/swearing/violent man."

I agree with the above comment, this is always how I've seen it too.

I'm a fan of Pratchett, Wodehouse & Christie too, and from time to time enjoy a bit of baking, knitting, sewing, crochet, and a thousand other crafts and hobbies that I've picked up and put down on various whims. We had chickens when I was a teenager, silky bantams. They were lovely, but they weren't fenced in so a bit of a menace come shutting in time on an evening, I'd have to go searching for them to bring them in from wherever they'd plonked themselves down for the night.

Just spent two hours watching Michael Foran commenting on the IT evidence. God to be there in person.

It’s compelling context - shows how impactful this evidence. And also shows - that if we believe the evidence - there is no technical reason for the dates changing - the only other option is human editing.

To go to those lengths to lie to a Tribunal halfway through it - on something that was voluntary - he didn’t have to give up the phone at all.

Going to these voluntary lengths to present false evidence to the tribunal could be viewed as sociopathic…..

People with the condition might seem charming and charismatic at first, at least on the surface, but they generally find it difficult to understand other people’s feelings. They often:
break rules or laws
behave aggressively or impulsively
feel little guilt for harm they cause others
use manipulation, deceit, and controlling behavior

Anyhow - I have some share tokens to access Forans substack and his previous post court updates so do DM me if you’d like to spend hours getting more immersed in the case. Promise to delete all data after and keep it in strictest confidence.

I don’t know how he manages such beautiful logic through the density of layers but it is wonderful.

On a side note, I wonder if someone at NHS Fife have been applying pressure to DU to provide phone evidence?

Tho I also have an image of him and his wife coming up with the plan of manipulation and justifying it to themselves for all sorts of batshit reasons but mostly arrogance.

Oh look it’s Jamie Doyle and Isla Bumba signing off a Risk Assessment which notes the 9 protected characteristics in May 2025 - it certainly needs to be updated to include gender critical beliefs :-)

How could I have left out Dorothy L Sayers? I have all of those. And I like J K Rowling’s work too, especially the Cormoran Strike series, which I am currently rereading because the new volume comes out on September 2nd. Thanks for the Stabenow suggestion, which I will check out.

Last night I was reading these threads last thing, went to sleep and dreamed I was trying to get cash out, but the cash machine kept giving me riddles in the dulcet tones(? What is word for written tones?) of the Fifer and every time I answered a question wrong I paid for something else instead. I donated two hedgehogs to someone for their garden on one attempt. I never did get my £20 to get home. I've finally read the pertinent parts so I could come and post about it on the next thread!

The section of Pratchett I sometimes find myself thinking about in current times is from ‘Thief of Time’:

I read all the Pratchett's long ago (should reread, have recently chucked a worthy tome back to the friend who loaned it to me as being Too Bloody Boring). I intermittently make jam, chutney and pickle, knit, crochet, sometimes sew, and enjoy the garden.

I'm not sure how many fellow FWR wims are dog walkers. We have two, and I take them bloody miles.

Upton told the tribunal that, on two occasions before the Christmas Eve incident, Peggie had left the changing room when Upton entered it and had stood outside. Giving evidence in February, Peggie said that she was “embarrassed” during the third incident because she was menstruating, and she insisted that she was not drawing comparisons with a convicted rapist when she compared the situation to a “biological man in a women’s prison.”

As such, we are looking at those past events through a new lens, and that could be important.
“There are various rights at play here, so FWS alone will not determine the outcome. The employment tribunal will need to consider the specific facts, acts of both parties, and the rights of the other employees. But it will certainly loom large over this hearing, and in terms of timing, this case has come right at the point when the public are focused on this topic.”
The tribunal hearings are expected to finish on 28 July, with judgment to come at a later date.

Well, Denton's can fuck right off for a start. They were instrumental in all this bollocks starting with their "document".

Even without FWS judgement, NHSF were not adhering to the 1992 regs.

Also DU doesn't have a GRC so their point is moot.

You would expect a partner in a law firm to know these things.

There is another important legal point, the Supreme Court didn’t change the law. It merely stated what the law was and always had been. The fact others misinterpreted it, or relied on unlawful Stonewall law is irrelevant surely. Fife have the money for top lawyers. If they chose to use Stonewall law that isn’t a defense to breaking the law.

Okay, been resisting but here I go.
Bake (obvs), bread crackers cake cupcakes etc. Did the wedding cake and cupcakes for DD2. Not so much sweet stuff as Mr B swore off sugar.
Jam/Preserves, yes but much less see sugar comment above. Still make crabapple jelly (american style) from my trees + friend. Best thing ever for peanut butter & jam sandwiches.

Not to hijack the thread but that is completely unacceptable- I’m so sorry your mum had to go through that. It’s definitely something that should be raised to PALS or the ward sister, if you can muster it. I’d hit the roof if I found someone treating a patient like that.

I think it’s standard treatment these days. My elderly Mum was in hospital and wanted the toilet. I spoke to the HCA sitting on the ward who checked her notes and said she has a pad. End of conversation.

Favourite books of Pratchett -

I like to read them in series groups and like the one offs a little less. My favourite grouped books are -

The Watch books in particular Night Watch. The line (roughly) 'when they saw their leader had fallen, the men with the lilliac, they fought like tigers. Not skillfully I'll admit but they just took the other side to pieces' always means I have to take a minute to compose myself. Best Watch characters - Vimes, Sybil, Carrot, and I have rather a soft spot for Willikins.

The Witches - who wouldn't love the trio of Granny, Nanny and Magrat. Best book Wyrd Sisters. I love the bit when they're leading the Players on the path to Lancre and keep pretending to be humble wood gatherers. Lawks.

The Moist von Lipwig series - in particular Going Postal. The idea of a name being sent along and back the Clacks network forever is a lovely one. Adora Belle Deerheart (Spike) is a fabulous character, played fantastically by Claire Foy in the two parter tv series.

Tiffany Aching series. There's a lot of nods to Scottish folklore about fairies which is fascinating. (As an aside, that folklore still exists today in Scotland to a certain extent - rowan trees and silver in a pram as the most obvious examples). I also like Tiffany's choice of weapon!

I also like Death and Susan and wish Susan appeared in more books.
