NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #41

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Isn't this about trying to get the SEEN network shut down? The claimant is suing both the Environment Agency and Andreas Mueller.

I'm not clear whether the environment agency needs to take a side on the issue.

From what I can see Andreas Mueller is funding his own defence, so I assume the Environment Agency just need to show that they haven't done anything wrong.

Not according to his page on Crowdjustice where he is clearly appealing for funds.

This is the first time as observer that a witness has sat side on facing the counsel. We can see his face and he is looking counsel in the eye and seems to be very candid, ie body language matching candid answers (that are not great for JR who is now objecting and has been asked by J to wait her turn).

Oooh, witness didn't produce report (DU's report) that board has appended to Mr Donaldson's witness statement "I haven't produced it but I'm comfortable with it".

I'm perhaps being a little slow this morning, but why are they questioning PD about DUs phone notes? I thought PD would be the witness they questioned about whether due process had been followed in regards to the order to submit emails and JB the guy that should be questioned over phones?

He was chosen to do this by NHSF management because in the past he'd had some knowledge of IT forensics. In other words, cutting corners.

Something like that. The suggestion has been made that he didn't make notes at the time. And that he added stuff after to fit his story. But I'm struggling. The junior is explaining things more clearly now. I think 🤔 😀

CE - this doc you did create, response to JB report, wrote summary. Cannot give explanation for dates issue, but do not believe DU tried to mislead. You say you don't believe it, but it is one explanation?

When you start looking through Scotland's People, you see a lot of women named after their Father who had been killed in the First World War. Some of them are the usual ones you see - Williamina, Robina etc but there are some unusual ones too - Donaldina and Jacobina were two which caught my eye.

I've just read in my current book of a baby girl in Scotland who was named after both her late father and the war cemetery in which he was buried - Vermelles Hughina Munro.
