NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

KS I've trawled all my emails but before this I wasnt aware and hadn't made a full search. I wasnt prev asked to search all my emails until v recently.

KS Only when I was asked for it I didnt recall it and was asked to look for it
NC You were never asked until v recently to trawl for any material that wld fall into that order?
KS As part of this process, I dont recall all emails. We were asked for emails that pertained. I dont recall being asked to trawl my email re this list until the past few months
KS We had a mtg in April that had a legal order to search for emails ourselves or someone wld have to do it. Wld have been April or May.

Hang on, Peter Donaldson is going to be a witness in the next few days. I wonder if he's going to be asked what notifications he sent out for relevant parties in NHSF to disclose relevant emails.

NC is going to be aiming to find that KS was asked to provide emails much earlier than she's admitting in order to cast doubt on how truthful she's being.

So KS is saying they were not asked until April to disclose? I find that hard to believe, even for Fife.

You can see why NC has started with this subject. It's to demoralise KS and to show the panel, right from the start, that perhaps her evidence will not be 100%.

I'm wondering if anything on the phone alluded to email comms too.

Surely if other upcoming witnesses managed to submit their evidence in time it would mean that PD has fulfilled his obligation to notify staff of the order.

If I were KS right now I would feel like a rat in a trap, she must know that something's coming, and that something aint good.

I'm going to have to iron and scroll at the same time.

And maybe try and find a not-to-wet bench or tree stump when I take the dogs out later into the soaking world that East Anglia has become, and try and catch up a bit like that...

Having said earlier that I didn't want to witness a massacre, I'm here glued to the coverage and ghoulishly wanting there to be a big trap up ahead.

Or to put it another way, NC can ask PD if he was negligent in instructing parties in NHSF in a timely fashion and I would imagine he will not be going out of his way to protect KS.

Does anybody know what the discussions behind closed doors are about? Obscure points of law, negotiations, what? Because they are late starting every day - is it discussion or is it just inefficiency?

Yet no one suggested that one simple way they could be separated would be for DU to respect the other 200 female identifying women ( women) in the department for the remainder of his FOUR shifts by not using the FCR?
