NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #36

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Don't know whether to laugh or cry when KS says:

No compassion shown for SP. No discrimination against her, clearly. She is a very black-and-white thinker, it seems.

is NC going to get a chance to cross examine given the time? Is the phone guy going to appear today?

I'm not following something - who completed a formal gx (can't find what gx means in the abbreviations) about the alledged 'racist' incident and if it was formal, why has it been described as hearsay?

Actually Sandie didn't even recall seeing Dr. Upton in this second instance. Dr. Upton sent some panicked email saying he felt unsafe and ran out in his socks or something, chases what was going to happen. From my recollection of Feb.

I don't hold that it was too challenging and difficult to move or swap shifts to keep them apart. Sandie always works nights and said she was willing to work any nights. All you need to do is go down the list and find substitutes for any overlap. It seems like they didn't want to in any way move Dr. Upton.

I mean someone has to do that when a doctor is off sick presumably anyway. It's not rocket science. And whilst I don't support DU, generally if an employee has made a claim of harassment it seems reasonable in so far as possible to move them so they don't interact while this is investigated.

And her justification for believing BU is that he is a doctor?

These women are so entrenched how can they not see SP view at all even just from a personal ‘i know how i would feel’ perspective.. you dont even have to agree to see it from a different perspective..

The NMC obviously demands that nurses are like the door knockers in Labyrinth - one must always tell the truth, one must always lie. Keeps it interesting, not like the boring, never dishonest doctors.

It’s a cult, no debate, no dissent, just validation and affirmation.

KS needs some decent professional supervision to address her mothering of Upton. This is not a good or healthy professional relationship being described at all.

Noted that she referred to Peggie as 'the claimant'- very impersonal. She has not an iota of compassion or empathy for Peggie. She dehumanises her in order not to have regard for her.
