NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #35

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

I don't expect to hear much, if anything, about them in cross examination. That will be a subject for summing up.

I am greatly looking forward today to how Kate Searle, who let's not forget is a witness for NHSF/JR, defends her emails. JR is a talented KC but surely all she has is to continue to present SP as a nasty bigot and KS as the entirely reasonable person defending the poor ickle Doctor Beth. Because KS followed no process, didn't hear Sandie's side and condemned her to all and sundry. I imagine NC will be on fire.

Apologies if this has already been posted - I'm trying to keep up but it's a struggle when you see dozens of new posts overnight!. Sandie's daughter has answered the claim by one of the NHS Fife witnesses that Sandie disapproved of her daughter's lesbianism.

I agree that’s what JR is attempting to say, but the fatal issue is that if it was true there would be datix providing evidence of it because it would be a serious workplace issue. There aren’t, not in the 30 years that Sandie Peggie worked in the one hospital.

Which means that if it was true every person who supposedly “knew” about it would be guilty of failing to evidence it (which again comes back on DU’s support club). When really, it’s much more likely they just made it up (along with the patient safety concerns, as they have now admitted) to justify going nuclear to keep Dr Upton happy.

Most of the outrage recently has been about appalling practice from NHSF employees- data protection, hearsay, failure to follow procedures etc. Real witch-hunt type behaviour. Shockingly unprofessional.

Independently of the core issue, NHSF have been a shit show. Sandie was treated appallingly and that’s what this court case is about.

and even if she was a bigot, how does that provide a defence for her employer failing to provide a single sex space? How does it change the fact that on every analysis Dr U was a man and had no right to be in the changing room?
