NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #32

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and was expected to last 2 weeks. However, after 2 weeks it was not complete and it adjourned part-heard. It resumed on 16 July and the last day of evidence will be 28 July and then there will be 2 days of submissions from counsel meaning that the hearing will end on 30 July.

The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton gave evidence from Thursday 6 February to Wednesday 12 February.

Access to view the hearing remotely was obtainable by sending an email request to [email protected] by 5pm on Wednesday 9 July. Detailed instructions were provided here:

Would it be possible for people to turn their attention to this post by@FayeRCfrom a previous thread:

I have a similar court case in England's side which aims to protect single-sex facilities for women. It is in need of support to cover legal fees and can be found by searching for Faye Russell-Caldicott on crowdjustice.com

"I have issued an employment tribunal complaint against NHS England for indirect discrimination on the basis of sex (women), religion (Islam), philosophical belief (gender critical) and disability (PTSD) for having a policy in place which effectively renders the supposed single-sex toilet, changing room and showering facilities as mixed-sex."

Do we reckon NHS Fife have clocked off for the day yet?

RedToothBrush · 18/07/2025 21:45

I'm getting this 'video' rolling in my head.

In deep Geordie accent
"Day 4 in the reboot of the Sandie Peggie Tribunal. Beth is in the kitchen crying after fight night. She is being comforted by one of the other housemates."

alsoFanOfNaomi · 18/07/2025 21:45

Transgenderuk reddit seems to be studiously ignoring the whole thing, at a glance.

nettie434 · 18/07/2025 21:45

Interesting post on X from Joanna Cherry saying that the Scottish Information Commissioner has described NHS Fife's statement as 'petulant'. The article also notes that case has cost them over £250k. How can they justify this use of public money?

I hope they add the overtime bill to the information they supply to the commissioner office.

thatsthewayitis · 18/07/2025 21:46

just when you think they cannot make things worse for themselves NHS Fife does. It's kind of awesome.

cigarsmokingwoman · 18/07/2025 21:46

honestly, every time I think I've peaked, a higher peak appears.
How many others will have been peaked by today's shambles?

nauticant · 18/07/2025 21:47

NHS Fife are currently Wile E. Coyote who's run off a cliff, and it still running in mid-air.

OP posts:
Chariothorses · 18/07/2025 21:49

I read on x in a post by a lawyer that Fife could just concede, as the evidence against them is so overwhelming. Is that correct? It would save costs of all their chosen witnesses time still to come and more humiliation! But as they are sharing legal defence with Upton perhaps they don't want to?

Reports of a new mountain range appearing in Eastern Scotland. They're calling them the sonny Upton-lands.
