NHS Fife have ‘noted the clarity’ and are ‘carefully considering judgement and implications’

They need to throw in the towel now. Sandie's right they are wrong.

Just heard on the BBC that Munroe Bergdorf is going to be speaking to lawyers about this. 😆

He's a race grifting arsehole. A disgusting racist bigot.

NImumconfused · 16/04/2025 12:25

What a relief. We were right. They were wrong.

If I knew how, I'd attach a clip of David Tennant as Crowley doing the "you were right, I was wrong" apology dance in Good Omens series 2 (not likely that he'd ever apologise in real life, obvs)!

I wonder whether the Australian Supreme Court will also demonstrate some common sense and overturn the federal court ruling that humans can change sex in the Tickle vs Giggle case.

I was wondering about Tickle vs Giggle too. Sex realists in Oz must be wondering how their courts came to the wrong conclusion.

As it stands Women in the UK are biological women only (😁😁😁😁😁😁😁😁❤️❤️❤️❤️❤️❤️ SHOCKER), whilst ‘Women’ in Australia and much of the rest of the world are, well, anyone who wants to be, apparently.

Thank you TERF ISLAND. Although not so bloody R are we, anymore. 😁❤️

The really good thing is that we have discovered today that there is liberal alternative to TWAW and to Trump

Now the interpretation is clear we can say the EA is a great piece of legislation. It protects trans people from discrimination but also protects single sex spaces.

Yes ❤️ 💯

Will this impact the next part of the Sandy Peggie case? I mean the law hasn't changed, but will this ruling weaken NHS Fife's arguments?

Yes it must surely

NHS Fife argue that it was OK for Dr Upton to use female changing room because they identified as a woman

But Supreme Court says that you're not a woman if you're not bio female

Therefore, Dr Upton should not have been permitted to use female changing room

I predict a prompt statement from NHS Fife, saying they appreciate guidance from the Supreme Court as it's all been so unclear previously and they're carefully considering their position. Closely followed by a confidential settlement of Sandie Peggie's claim, coupled with a bland statement in agreed terms saying it's been difficult for all involved / let's move on. Dr Upton will be furious

Edited to add - I was right ! Statement already issued https://www.thecourier.co.uk/fp/politics/5223082/nhs-fife-sandie-peggie-tribunal-supreme-court-ruling/

MissScarletInTheBallroom · 16/04/2025 12:22

Indeed. This has been the law since 2010 so it potentially has ramifications for any decision made in the last 15 years which conflicts with it.

But, it's always been clear that Upton could not have had a grc, so I don't think this makes any difference? Even the SMs' lawyers said quite clearly that people without grcs remained in their birth sex. I think NHS Fife didn't have a leg to stand on either way - which is doubtless why they'd like to exclude us.

Can anyone confirm the reports that the Scottish Gov aren’t going to appeal this mornings judgement? 🙏🏻

That's your view. Not everyone here's by a long shot.

Certainly the SNP are committed to staying in the ECHR, so my point is if the Scottish government decides to go down the ECHR route then they need to know what the gamble is and why might be at stake even if they do win.

I honestly don't see many options here for the Scottish government.

If they appeal - especially after we've had all these explanations about how sex is not gender - and they win, all that does is call upon the law to be changed.

If Labour don't do it, it risks Reform gaining political ground with the point.

If they go to the ECHR, see above.

If they quietly accept it they will be vilified by their own. But they may not have good grounds to appeal anyway. This raises the point that politically for the SNP appealing with a shit case, they are highly likely lose might well be their best escape route!

And this has always been the case.

It is only the nonsense of Stonewall Law and their opinion that anyone who opposes TWAW is a bigot that has been poisoning the well.

I wouldn't it past the Aussie legal system to claim that biology is different in the southern hemisphere and the UK Supreme Court opinion means nothing!

Plaid Cymru are going to have a fit and a half, they've already rejected Cass. They'll use it to claim it's all the more reason why Wales should have independence and so it can have control over making it's own laws.

I have an appointment to see my MS tomorrow. She banned me from talking about women's rights and GI some years ago because she says there is no point: she believes TWAW and I don't and that's it. I'm going to have a lot of fun with her. It will be difficult to remain polite. I'd suggest that all other GC women here in Wales do the same. Hold your MSs feet to the fire.

I think possibly we may need to have a couple of threats of court action here in Wales to get reality centre-stage — but as Drakeford and Hutt have fucked things up so badly that Reform is a shoe-in next year, women may not have to bother. What fresh hell will Reform have for women, I wonder?

murasaki · 16/04/2025 12:34

Heather Herbert on Sky News. Sorry, Heather, a judge can tell you who you legally are. And did.

Lillith111 · 16/04/2025 12:16

You certainly don’t represent my feminist views and give gc women a bad reputation by peddling this racism

The SC has just confirmed that sex is a biological fact, something people particularly on the left have been arguing against for years.
Next step is to stop the flood of sexual assaults we are allowing in, and again defended largely by those on the left. Women won’t stand for it much longer, call me what you like I’ll fight against it as long as I can.
the battle against trans women in women’s changing rooms is won, the battle against sexual assaults from all causes should be next whether you like it or not.

I don't think it was a leg they were attempting to stand on. Some other appendage, which the legal definition of woman excludes,

What a relief. We were right. They were wrong. Enduring love, respect and thanks to FWS and all behind them. You have been amazing and you will go down in history.

Now...
Scrap Stonewall and remove Ruth Hunt from the HoL.
Tell the Welsh government that their LGBTQ+ action plan is illegal.
Go to all the MPs and MSs and MSPs who've let women down so badly and tell them in person what we think of them.
Ask how Lady Haldane got the law so wrong.
Defund the BBC: I was forced to watch the judgment on the BBC and the immediate response of the commentators was to talk for 15 minutes about how transpeople were the most vulnerable and needed tons of support. The tone was shock that the court could have been so unkind and how horrid this would be for all the delicate trans flowers.

And a thousand other things I've forgotten right now.

I'm thinking of all my terfy contacts in Australia and New Zealand and Canada and sending them hope and courage. Their legal system is based on ours and I hope their courts will be sitting up and listening to this judgment and will amend in line (as with Cass around the world) so that the women there don't have to go the long route FWS have been forced along. Thinking particularly of Sall Grover, trapped in Tickle hell. Surely this ruling's reverberations will help her?

I always suspected Lady Haldane is a Terf and/or thought the law so mudfled she wanted it kicked up to a higher court.

Madcats · 16/04/2025 12:36

I don’t think the commentators have picked up on it, but this ruling also means that transmen who decide to get pregnant (though surely this is one of the most female-affirming act possible), will now be afforded full maternity rights even if they do have a GRC.

I'm fine with that. All women should get maternity rights.

Oh yes, I think Fife are on a hiding to nothing and were anyway even without this judgment.

But if I've understood correctly, if organisations are going to use the single sex exemptions in the Equality Act to provide services to one sex only, it must mean biological sex and so it is irrelevant whether someone has a GRC or not.

That means that all these rape crisis organisations purporting to offer services to women (which they can only do using the single sex exemption in the Equality Act) but taking a trans inclusive interpretation of the word woman have not been applying the law correctly.

It's a genuine win for trans rights but then it's only trans men and TRAs don't really care about them.

On Twitter, John Swinney says "The Scottish Government accepts today’s Supreme Court judgement..........."

I think safe to assume no appeal !

What a bloody relief. Does this now mean the charmer Abbi Taylor cannot be sent to a women’s prison?

the framing by the mainstream media has been predictable...
