This is good news. But probably not picked up on because they don't shout as loudly.

I wonder what they would actually say about it? Is there some convoluted logic whereby they would argue that they should be protected as biological women, but also legally affirmed as men? Freddy McConnell was just obsessed with being registered as the "father", I think - I don't think Freddy would be shouting from the rooftops about having maternity rights upheld. I'm not sure how big the "pregnant man" demographic really is, among TM.

I understand about protection through the characteristic of gender reassignment, but I don't understand the rest of the sentence. How are they protected "in their acquired gender"?

I could obv just wait for the promised handout, but wondered if anyone else understands it and I'm just being obtuse?

In other words, if someone thinks a MCW is a woman and discriminates against them or harasses them on that mistaken basis, they can claim (that rule applies to everybody, male or female, gay or straight etc).

It is very clear. Sex means sex observed and noted at birth, and woman means adult human female.

I don’t think the commentators have picked up on it, but this ruling also means that transmen who decide to get pregnant (though surely this is one of the most female-affirming act possible), will now be afforded full maternity rights even if they do have a GRC.

As they should be.

Another positive to this ruling is in regard to accuracy of statistics - as the protected characteristics in the EA are those that data is collected about (often legally mandated), and sex has been clarified to mean biological sex, data collection will now have to be sex and not gender, meaning accuracy in e.g. the census, crime reporting/figures. As far as I can see, anyway

I’m really really really happy. I’m an advocate for protecting and making safe spaces for our trans and gender fluid community, but that should never ever have been to the detriment of biological women’s rights. There is room in this world to protect everyone who is potentially vulnerable, but every protected group has individual nuances and needs and you can’t undermine one to support another.

We are finally moving on from allowing personal beliefs to trump biology. There is so much also to unpack about the undercurrent of homophobia that is embedded in the trans movement and the deep rooted misogyny that allowed biological men to continually bully and abuse biological women, (and absolute silence about the rights for women who choose to be men) but right now I’m just really bloody happy.

I would like to see the UK and Scottish (and Welsh!) governments issue immediate clarification to all government funded organisations, including the police, NHS and councils, anyone that provides services and funding for the public, that they must take immediate action to ensure their policy and practice is in keeping with the law ie reality. This means tackling trans activist cruelty to women head on.

Ie protect SS spaces and facilities, arrest males entering SS spaces eg where women are undressed, review policies and ensure the human rights of women are protected. For the past few years many of them have pretended men are women and in their PSED assessments have said there is no negative impact on women as a sex of lying men are women, even though the evidence has shown that to be untrue.

Surely this mean that if a TW is not allowed in a women’s prison because he is not biologically female, then he can’t be discriminated against in a men’s prison because he is TW? If so, it will be on the prison system to provide a safe space for TW which does not mean opening up women’s spaces. Similarly all other women only spaces - as a pp said - third spaces will have to provided, which is what we have all advocated for all along. The trans activists have consistently (and, I would argue, purposefully) ignored this fact - women do not hate TW, we are protecting our spaces from men, no matter how they identify. Otherwise live your lives in dignity.

Why would 3rd spaces be required? The law is very clear - TW cannot be discriminated against when using spaced designated solely for males.

Did anyone listen to Jeremy Vine on radio 2? He’s just done a section on this and the tra they had on was ridiculous, apparently 2% of people born are intersex and cannot be sexed at birth and actually it doesn’t matter because how do we actually know what sex people are at birth anyway. JV didn’t really know how to react to that, I’ve always found him on the be kind side but I think that even shocked him as of course we know at birth what sex people are!
all the usual arguments were trotted out, focusing on trans rights and how they are the most at risk in society and ignoring the dangers women live with everyday.
There was one women who called in who was fabulously clear and made so great arguments.

I’m not a lawyer, but I think you can remind your employers of their responsibilities under the EA. If they allow the individual in question to continue using the women’s toilets, you could claim sex discrimination/ harassment in an employment tribunal. I can recommend a very good barrister if you need one!

Regarding trans people still being protected under the EA. I would say that means they are protected from discrimination within their own sex class. And rightly so. Transwomen shouldn’t be treated any differently accessing male spaces as say, gay men, short men, nervous men, long haired men etc. The law is absolutely clear that men need to accept other men, who happen to have a GRC, in male spaces.

So using a recent example, Dr Upton should not be prevented from using the male changing rooms. The good Dr should be free from discrimination and harassment from other men, despite choosing to wear dresses, using a particular name or behaving in a feminine way. No transwoman should be made to feel unsafe, harassed or excluded from their own single sex services or provision.

That doesn’t mean Dr Upton can have access to the opposite sex provision that is for women, and excluding the good Dr from these spaces is not discrimination. Because of sex.

I have an appointment to see my MS tomorrow. She banned me from talking about women's rights and GI some years ago because she says there is no point: she believes TWAW and I don't and that's it. I'm going to have a lot of fun with her. It will be difficult to remain polite. I'd suggest that all other GC women here in Wales do the same. Hold your MSs feet to the fire.

I think possibly we may need to have a couple of threats of court action here in Wales to get reality centre-stage — but as Drakeford and Hutt have fucked things up so badly that Reform is a shoe-in next year, women may not have to bother. What fresh hell will Reform have for women, I wonder?

I would but my MS is the Queen B herself, there's absolutely no point in talking to her, her entire political 'identity' is based on this crap, there's no way she's going to budge. I also don't trust myself if I were to meet her. All I can hope is she gets voted out finally next year.

Good luck with yours, at least you now have ammunition to take into the meeting with you, I wish I could come and support you. Imagine me there in Green, White and Purple spirit. 🦖😁

I don't think you can appeal the Supreme Court. I think the only next step would be to go to the ECHR.

You have to have actually been oppressed yourself and failed to get justice in your own country in order to be able to appeal the ECHR. Not the case here. This is only clarification of the law.

@CapabilityBrownsHaHa also as the judgement confirms that men are men regardless of GRC status has always been law, I think that means that female members of the public who have been searched by the male prison officer that hit the press in recent months for searching women as he has a GRC can now sue for state sanctioned sexual assault.
(Not a lawyer though- it will take a while for the impact of this judgement to become clear)
