NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #10

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 February 2025 and is expected to continue for 2 weeks. The hearing commenced with Sandie Peggie giving evidence. Dr Beth Upton started giving evidence on Thursday 6 February.

The judicial standards dictate he is to hear the evidence and give no indication of what his decision may or may not be.

This. If the judge expresses anything that could be interpreted as an opinion at this stage it could lead to a successful appeal. He may well think that DU is stark staring bonkers, or that he is lying through his teeth, but he absolutely mustn't do anything that even hints at that.

Throwing this in here: on a previous thread, there was speculation that Upton's use of 'sat' to discuss SP's position was some kind of Scottish usage. It really isn't.

I only ever hear English people or people with English parents using that expression and they use it to mean "sitting". Upton was contradicting himself.

There is no consistency in, one one hand, being able to differentiate between categories such as 'Cis' and 'Transwoman' ( as he does) - but then claiming that there is no differentiation between them, for a start.

You cannot claim a trans status whilst also claiming the biological sex of your preference. You wouldn't be trans if you were already female. 'Trans' differentiates you from the start.

He is consistent in being illogical though. What NC needs to demonstrate is thgat he knows and understands full well why SP felt the way she did - and that is because he is male/trans. NC also needs to demonstrate that rather than SP being the bully - it is he who was seeking to control and dominate the whole situation.

I'm finding this whole thing infuriating. Judge, as nice as he is, needs to find a backbone and stop the waffling.
