NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

He seems to have a lot of breaks. There are so many stories about medical staff not even getting chance to go to the loo during shifts that I don't know how he was able to have note making breaks

I also saw nothing at first, using Safari on a Mac. Tried Firefox, also nothing. Finally Chrome worked. Don't know if it was coincidence or the browser.

I wonder how many colleagues have had to pick up the slack due to his note taking about SP. Or how many patients notes have suffered.

In my recent experience notes in the NHS are quite often dangerously poor anyway in a way that could cause medical harm if used as basis for treatment.

Long discussion about a child/patient who was seen in triage but left without treatment. SP didn't say hello to Dr U when arriving to discuss this case. But did give information about the patient. Didn't look at or acknowledge Dr U while providing report. SP left the Drs area. Dr U made notes about this interaction "took keep track of them" "when I have these interactions I try to write them as soon as possible as they are fresh in my mind" "I wanted to make sure I had a record of these incidents as it was unusual" "I was concious that unfortunately I am aware that there are people who object to the existence of trans people and I am vulnerable to that sort of tension" "I wanted to be able to say in the future about what had happened so there was an accurate understanding"

Goodness. So SP did her job, communicating to DU about the patient, and then he made notes about how she hadn't been friendly enough? Seems an odd thing to do in the middle of delivering patient care.

For those watching, can you tell how old the panel are?

I'm assuming once you get to that position you can't be a youngster, but I'm hoping that they're not intimidated by the fact this man is a doctor. Age can definitely help with that.

He was wearing 'raspberry' coloured scrubs and trainers when he went to the changing room. I think that's red/maroon to most of us?

But will the tribunal judge understand that? I think it might be something we are all attuned to but he might not. And the judge's tone with him has been terribly gentle so far.

Is it possible that, at some point in his life, somebody stressed to Beth that it was important to ensure that he looks at somebody when he speaks to them to mask some of his autistic traits.

A rule must be followed and all that.

Now on to the Xmas Eve CR meeting.
Finishing shift and went to CR to get changed.
Saw lots of staff to say Merry Xmas but can't remember much about them
Wearing scrubs and trainers on entry to CR
"I arrived with 2 colleagues" and "it was empty". "we were chatting about xmas plans... " "We all arrived at roughly the same time" "get changed in the corner facing the wall ... I am concious about the unpleasant attitudes of some people about trans people using changing rooms so I avoid any indication that I might be looking at them so I don't give the impression that I am looking at them. It is a shame but it helps me to feel safe"

So after his shift he goes around the sections specifically wishing everyone a merry Christmas. Including the lab, via a slip.

He reminds me of people who really do think they are special and that the world revolves around them. Probably not the only look-at-me-I'm-a-doctor type that does that, though.

But then, re the changing room...

"I don't like the idea that people might be looking at me when I'm getting changed", he says! He needs to feel safe.

The sense of entitlement is so overwhelming. It's way beyond male entitlement. It's male entitlement on fucking steroids (ironically).
