NHS Fife tries to silence nurse - Sandie Peggie vs NHS Fife Health Board and Dr Beth Upton - thread #4

1000 replies

nauticant · 06/02/2025 11:39

Sandie Peggie, a nurse at Victoria Hospital in Kirkcaldy (VH), has brought claims in the employment tribunal against her employer; Fife Health Board (the Board) and another employee, Dr B Upton. Ms Peggie’s claims are of sexual harassment, harassment related to a protected belief, indirect discrimination and victimisation. Dr Upton claims to be a transwoman, that is observed as male at birth but asserting a female gender identity.

The Employment Tribunal hearing started on Monday 3 January 2025 and is expected to continue for 2 weeks.

Access to view the hearing remotely can be obtained by sending an email request to [email protected] headed Public Access Request (Peggie v Fife Health Board) 4104864/2024 and requesting access.

seems rather flimsy concerns on his part thus far

Mmmnotsure · 06/02/2025 12:49

Think how very fast this man is speaking and how rarely the judge has asked him to slow down. V different from Sandie and Maya.

I think the inflection thing is scottish - he sounds like my mum 😂

Apols to your mum of course!

IME doctors put monitors on patients quite regularly. If I get to my patient before the nurses on the admission ward I'll do it while I'm talking.

I'm a consultant.

All NC needs to do is slowly and clearly get him to repeat what he has already said. The sunlight is blinding.

Agree!

Shortshriftandlethal · 06/02/2025 12:49

SP most likley knew he was making notes about her, and also knowing he was privileged she had to tolerate this conduct...no wonder she was so angry.

InvisibleDragon · 06/02/2025 12:50

Tbf, I tend to speak very fast (a d unfortunately pompously) when nervous - DU is probably doing the best they can.

Bluebootsgreenboots · 06/02/2025 12:50

'I said hi'??!!!
Why would you feel the need to say 'hi' to someone in the changing room? If you all started trying to initiate conversation in a work changing room I'd find it slightly weird.

Same.

And my experience in resus is that there's even more blurring of who does what as long as it gets done.

No detriment to the patient in this situation so why on earth is this part of anything?

Has there been any explanation at all as to who those people are?

They can't be witnesses. They can't be observers or they wouldn't be on camera.

What is their role?

They are his supporters. Because he is special.

AnnaMagnani · 06/02/2025 12:51

I'm a consultant and if a nurse asks me to do obs, I JFDI.

Mollyollydolly · 06/02/2025 12:51

I'm just reflecting on some of my interactions in a high stress work environment (broadcasting) and wondering how on Earth he can survive in an A&E department when he's so fragile.

"it makes you feel unwelcome" "it was sad, disheartening"
Any formal concerns
"I didn't want to make a big fuss as a new person or draw attention to my trans-ness... it felt a bit harsh to escalate something which was uncomfortable and sad for me without someone having taken direct action and without knowing why they had done it. I dodn't think it was worth escalating at that point"
Bundle p261 18/12/23
An incident with a patient in resus triage. Dr U in last hour of shift
Patient short of breath - accepted patient at end of shift thinking he had time to get them into a better condition before handover for day shift.

An ECG was being taken by the nurse. Dr U's would usually stand back to avoid interfering the with the ECG result but in this case the patient was too unwell (and Dr U only had an hour) so they went into the cubicle (noting that SP had left without finishing off the tests/observations.

SP returned to do the observations. Dr U asked if they should leave so that the obs could be done. SP said "you could do the observations". This was unusual. "she left the room". "I did the observations and recorded them in the chart"

"I have definitely done observations for patients" "I have not had a person in a resus room ask me to do that before" "It was an unusual thing to say especially having started something"

"I went to the Dr room to write up the notes and review tests etc" "I came across SP and some other nurses." "SP was telling them that Dr had done the observations... calmly just passing on information to the other nurses". "I categorised this as unusual - it is always difficult to say. This is now a 3rd time with someone being uncomfortable being in a space with me .... and asked me to do one of their tasks.... bit weird and offputing"

Was Dr Theo Upton born Theodore Benedict Upton in 1995 in Edinburgh? If so, I'm 99% sure that he married a woman in Cupar in 2021? This information is from Scotland's People website. I'm not saying anything that isn't out there in public.

It’s pretty clear DU was harassing SP from this. He couldn’t wait to get proof of something against her IMO

Yep. He was literally just waiting for an opportunity to take someone down. It honestly didn't matter which "uppity woman" he took down!

Sensible!

ChimpanzeeThatMonkeyNews · 06/02/2025 12:52

Why is it so terrible that she asked him to do something??

I know he's saying that it's beneath him as a doctor.

Was she not bowing and scraping sufficiently??

Mayaisashero · 06/02/2025 12:52

The thing is all these people 'being kind' are NOT being kind or even professional to his patients. They are being abusive to them.

I suspect therefore a lot of it is just wanting to not be bullied by the organisation as SP has been.

I am almost in tears imagining him being let loose on dementia patients who absolutely recognise sex and do not have the capacity to pretend or keep up his delusion.

I think the inflection thing is scottish - he sounds like my mum 😂

I'm listening to the feed, so can't tell for certain...but the traditional Fife accent involves lifting at the end of a sentence - but that's dying out.

I'm in my 60s...my teachers at primary school used to try to encourage us to iron that out.

CriticalCondition · 06/02/2025 12:52

BU - I categorised this incident as unusual. Not unreasonable but unusual. It's a bit weird and off-putting. Nurses usually explain they have something else to do if they ask you to do something.

KnottyAuty · 06/02/2025 12:53

I am gagging to know about the notes he must have written about all the other staff... anyone else?

That is interesting, as SP could have said “yes leave the room whilst I do the obs” but that would also have been wrong. SP couldn’t win.

Shortshriftandlethal · 06/02/2025 12:54

"JR: How did you feel DU: Just unusual"

It's all about feelings now......only his mind you, and even then he doesn't seem to have great emotional literacy

Mayaisashero · 06/02/2025 12:55

AnnaMagnani · 06/02/2025 12:51

It shows it's about power, control and abuse quite clearly doesn't it that he takes offence? What a horrible environment for the female nurses working with this man.

Walking on eggshells after what's happened to SP for just wanting a single sex space.

Coercive control by NHS fife of its female employees. The people allowing this are sick.

Again, just almost in tears imagining any dementia sufferers in this hospital trust's "care" (/abuse).
