Does anyone else not care if a 'hate incident' is recorded against them?

For some people it will mean absolutely nothing. Especially older people with no intention of applying for a job.

What does is really matter? They don't tell you so it's not going to worry you. There's no crime so you haven't broken the law. There's no fine, prosecution or imprisonment.

It's a non crime.

Personally I don't mind if it's recorded somewhere that I did not commit a crime.

Obviously people in work who need a clear DBS will be frightened into submission by this law but there must also be lots of us who aren't?

I've been wondering what exactly is the point of NCHI's. I think that they are intended to get people used to the idea of snitching on each other and reduce mutual trust.

If they can do that, as well as make us deny the evidence of our own eyes and senses for fear of punishment than they will have succeeded in turning the country into a totalitarian state.

I think Jonathan Pie sums it up quite nicely.

I reckon he does! 😁

Also, if a person were to have an ‘incident’ on their record that doesn’t amount to a crime, then I wonder if it could lead to legal challenge.

They would have to know about it to challenge it.

Are those against whose names NCHIs are recorded told of this automatically, or do they not find out unless and until the submit a Subject Access Request?

I’ve looked into this a bit further, and haven’t been able to find anything concrete. I found a link to the website below, and if this applies to Scotland, it would seem that people can submit an SAR to the DBS, but it may not provide a full record. However, it would appear that a person can request a basic disclosure for personal reasons, for a fee. It’s unclear if a basic disclosure would provide information on NCHIs or not. I wonder if the DBS could clarify their policy on this new law, taking into account Data Protection law, through an FOI request?

This is the advice from Neale Harvey MP

"Write to Police Scotland along the following lines...

"I am writing to formally initiate a GDPR Subject Access Request (SAR) with Police Scotland to establish what data the force holds on me, and whether a ‘non-crime hate incident’ record is being held against my name without my knowledge.”

If you know the email address of a local senior officer you can contact them directly. The other option is to use the contact form there https://scotland.police.uk/secureforms/contact/…, or tweet them/DM them.

They have 30 days to respond. If they don’t you can escalate the matter to the Information Commissioner’s office using their online form.
