Does anyone else not care if a 'hate incident' is recorded against them?

For some people it will mean absolutely nothing. Especially older people with no intention of applying for a job.

What does is really matter? They don't tell you so it's not going to worry you. There's no crime so you haven't broken the law. There's no fine, prosecution or imprisonment.

It's a non crime.

Personally I don't mind if it's recorded somewhere that I did not commit a crime.

Obviously people in work who need a clear DBS will be frightened into submission by this law but there must also be lots of us who aren't?

Well, many accusations of "transphobia" are probably also homophobic. But it sure would be interesting if the reporting system were flooded with instances of misogyny... under "sexual orientation" (as the closest category to "sex-based") if need be.

Also, we will all have to submit regular SARs.

Can you imagine the optics of the Police spending so much time on this when crimes can't even be investigated. The criminal fraternity will be laughing and regular citizens will be furious.

Also regular FOI requests asking Police Scotland how many staff have been recruited/redeployed to cope with 1) complaints and 2) SAR's.

I believe it is because there aren’t enough police officers nor enough court time to deal with it, it would overwhelm the system.

Does that mean that non-residents can be guilty of the CRIME if committed in Scotland (as I suppose would be the case with any crime) or that mischief-makers can somehow report 'crimes' committed over the border?? This is delightful. I don’t even live in the UK or Ireland. But one of my adult children lives in Scotland. So if I can’t persuade my child, I’m hopeful one of the Scottish based Mumsnet witches will oblige in reporting one of my Tweets. The one where I state India W is a man would be ideal. If everybody reports everybody the police will be made to look like idiots and we will prove this new law is unworkable.

What would be the implications, if any, for something like engaging with Social Services?

I.e., imagine you have an incident recorded against you. For some reason, you later need to have social services involvement (bearing in mind that if someone has a dislike for your views, they could in theory report you maliciously). Would Social Services see this on your record and might that have an impact on how they dealt with you?

Obviously this only applies to people with young children.

I can see no problem with this.
Between every single time we are called Christian fundamentalists and SARs we will keep the police busy.

I'm going to have to do a SAR a lot, because I have a enhanced DBS so I need to know if I'm going to lose my job if I get a nchi recorded against me.

How often can we do a SAR?

How to contribute to overwhelming this absurd new law:

  1. Search on Twix for some high-profile trans person posting.
  2. Respond with something inarguable like “lesbians don’t do dick”.
  3. Wait for accusations of bigotry to roll in.
  4. Report each one as homophobia.

It reminds me of China's 'social credit' system ( there is a really good 'Storyville' episode on BBC I player about this).

You might not have broken the law, but you will have infringed some of the social 'rules'. In China there is a credit/debit system whereby you gain credits for 'good behaviour' and 'debits' for bad behaviour. Bad behaviour might include being caught, by facial recognition devices, eating or drinking on the metro ( which is discouraged); parking badly; taking part in a demonstration or rally, or simply making a complaint against officialidom of any sort.

There are thousands of ways to be debited, but only a few hundred ways to achieve credits. If you are in debit you might find it difficult to get a new job or find a new school for your child, for example, or you might be barred from using high speed rail services.

The social cedit/debit system is meant to act as a incentive to 'good' behaviour and a disincentive to 'bad behaviour'. Though knowing ( or becoming aware) that there is some official tracking system somewhere which records and monitors your behaviour is very dystopian.

Yes. You can report any utterance as motivated by hate and the police will be duty bound to investigate.

The police film about the hate monster says towards the end that the hate monster who presumably lives in Scotland doesn't like doing something positive, in fact he hates it. So there's concrete evidence that the hate monster is anti '+'. 😀 Anyone fancy reporting the hate monster?
