Does anyone else not care if a 'hate incident' is recorded against them?

For some people it will mean absolutely nothing. Especially older people with no intention of applying for a job.

What does is really matter? They don't tell you so it's not going to worry you. There's no crime so you haven't broken the law. There's no fine, prosecution or imprisonment.

It's a non crime.

Personally I don't mind if it's recorded somewhere that I did not commit a crime.

Obviously people in work who need a clear DBS will be frightened into submission by this law but there must also be lots of us who aren't?

Me too - it’s surprisingly easy, anonymous and only takes a minute. I saw it described perfectly as a clype’s charter. Police Scotland are going to be kept very busy in the coming weeks and months.

In all seriousness, one of these reported ‘hate crimes’ needs to be taken through the courts, it would cause distress to the accused, but in a court of law where you are obliged/required/made to swear an oath about telling the truth…how’s it going to be successfully prosecuted?

I reported it for myself rather than for someone else so it doesn’t ask for address, dob etc - and then just put the time/date of the tweet

You don’t have to put all that stuff in. At end of form they will say red entries that you have to fill in. I did 2 today

It seems rather odd that a person who had not committed an actual crime should somehow have an ‘incident’ on their record. It could affect a lot of people’s employment which, if a crime has not been committed, is just plain wrong.

Whilst I take things as a tiny win (Thanks JKR) I am too cynical to think that a new front isn't being opened up.

It is indeed, surely everyone has the right to know the details of a criminal allegation, who has made it and to be able to challenge it in court?

I’m afraid I share your cynicism. Though, I truly wonder how Scotland intend to enforce this law. I feel it will likely be unworkable given limited resources within the police. Also, if a person were to have an ‘incident’ on their record that doesn’t amount to a crime, then I wonder if it could lead to legal challenge. This will be interesting to watch.

They would have to know about it to challenge it.

Are those against whose names NCHIs are recorded told of this automatically, or do they not find out unless and until the submit a Subject Access Request?

Whoever thought up NCHIs is a shit-eating scumbag, as is anyone who makes use of them. All complicit in turning this place but by bit into East Germany.

The police should only be concerned with palpable harms, not hurt feelings. Scotplod are already cutting down on investigating actual crime to concentrate on this sinister crap.
