An MSP (Murdo Fraser) threatening legal action against Police Scotland after his twitter/x post was logged as a hate incident

I couldn’t see another thread on this - just wondering if a male complaining about ‘hate incidents’ registered against him will produce a different result compared with all the female complaints that have been dismissed.

An MSP is threatening to take legal action against Police Scotland after a tweet he posted criticising the Scottish Government’s transgender policy was logged as a ‘hate incident’.
Veteran Conservative Murdo Fraser said the force had ‘behaved not just outrageously, but unlawfully’ after learning that his name appears in police files for expressing a political view.
A trans activist reported the post on X, formerly Twitter, to Police Scotland whose officers decided it did not amount to a crime but should be classed as a ‘hate incident’ which will remain on record – even though no law had been broken.

Its a good point. Every single journalist writing about women's sports, women's rights, child safeguarding, any of this, will have a recorded NCHI. Every speaker on tv and radio who addresses this. Many are going to have a long list.

However if that's the case it's rapidly going to become about as significant as speeding points and parking tickets.

And if you share the article if I read pp correctly

I'm hoping more the level of library fines and star charts.

It seems Police Scotland are hiding some replies. Well, of course they are.

do we not think this will collapse overnight as being entirely unworkable? Come April 1 the koolaid nutters will think Christmas has come and will be flooding the Babylon with vexatious complaints by the skipload. This will be literally unmanageable -unless they recruit an entire cadre of admin staff. I dare say there must be a bunch of otherwise unemployable recent graduates from the university of despond with a 2:1 in grievance studies who would jump at the chance.

Mumsnetters in Scotland. Make sure you stock up on mushrooms and vibrators before April 1st! They'll be too busy to serve the regulars.

I suppose a test case could be is stating biological reality ok or not?

Or is it very unlikely to happen idk

I'm imagining Lord Robert Winston being hog tied and bundled into the back of a rainbow van after appearing to discuss biology on a TV programme.
Looks like where we're headed.

Brefugee · 25/03/2024 18:26

if the reports are filed with the person who made the report, it will be easy to find out who the vexatious litigants are, though, won't it?

Its the end of trust or faith in the law. It's an uprecedented attack on justice and society in the UK in modern history.

You can be accused of a crime, with no opportunity for justice, to defend yourself, to plead your case, to do anything at all, even to be informed that someone has informed upon you for their own reasons or due to their own dysfunctionality and difficulties with reality, and carry that penalty in a way that will harm all of your career and working life.

It's appalling. It's in the realms of Germany in the early 30s and I wish I was exaggerating. It's abhorrent. There will be nothing to do but avoid speaking to anyone you do not know well or trust, to avoid committing yourself in writing, and to avoid groups entirely with a reputation of being easy to offend. I have no doubt that MN towers will be hit very swiftly from April 1st by police demands for the personal data held on FWR posters.

I'm currently watching the series, The Rise of the Nazis. The similarities are jaw-dropping for me.

I'm not as up-to-speed as many here are as my concentration levels shot due to illness. I get a bit muddled on some things, too, so are happy to give an opinion even if it isn't spot on with technicalities. I also have difficulties remembering words - never helpful when trying to express an opinion.

However, even I can see how much this is following down the Nazi Germany of the 30s road.

One contributor notes that "quiet compliance" is needed for it to happen.

We are being heard. More people understand how ridiculous and harmful this is but fear speaking out for the obvious reasons of punishment. We need more men to step up to bring sunlight to this madness.

Maybe now it will happen.

Guess what? People are actually defending the law.

Several are saying he's a Tory, so he deserves it. Some are talking about the EHCR, tangentially. And one is even saying he should have been prosecuted:

'Mr Fraser clearly expressed a desire to see the rights of others infringed, by claiming that the right to define oneself as non-binary is not possible. By such indication he showed that he was opposed to non-binary people being able to define themselves as non binary and as a legislator in a substantive position to do something about it. That he was let off by Police Scotland is a disappointment as he clearly sought to infringe the rights of others using his position. The equivalence he used was nasty and demeaning he made it and his intent to deprive rights to others in a very clear way and this was laden with hate. He wants to claim the human rights he would deny others and that is intolerable. Tories are by definition nasty but Fraser sinks to new depths.'

Some people are sheep - alarmingly more of them these days. Especially when it comes to politics.

I have always voted Labour (soon to change!), but hearing some people blaming every dubious thing on one party (almost always the Tories) no matter what is disturbing.

They clearly don't think for themselves. A bit like the JKR haters.

I avoid these types like the plague. Until they can "show me the proof" I don't waste my time on them.

I could do with one of them to find my old abandoned in drawers tech. I think I've still got everything since my old Nokia from 1999/2000 ish somewhere! So there is a lot of stuff to sniff out!

Also, I am feeling very triggered by the constant references to lemon drizzle cake!

I've made a list of all offending posts by posters and will be travelling to Scotland on 1st April so that I can read them all again and be sufficiently triggered in my Yorkshire Tea and Biscuits gender.

I will report all of you!

ALL OF YOU!!!!!

Do you remember at Christmas when Dawn butler threatened to report mumsnet to the metropolitan police for being big meanies or something?

maybe we need to resurrect our cunning plans from then!

PurpleSparkledPixie · 25/03/2024 19:35

Let's hope you don't find a mushroom farmer or sex shop worker who LOVES LOVES LOVES lemon drizzle cake. They might just do two forms, one for you, one against 😬

Good grief, I was being facetious but there is the possibility it might actually happen 😮

I apologise for traumatic references to the citrus related thing that should Not Be Named, but at least I have not mentioned or produced the Weetabix Horror.

That wouldn't need the Scots Keystone Cops, that's a call out the army job.

Here’s a link to Police Scotland’s web page on Subject Access Requests: https://www.scotland.police.uk/access-to-information/data-protection/subject-access-requests

There is no charge for making a SAR. But you do have to supply a fair bit of personal information. Though you have to state your “gender”, sensibly it may only be Male or Female.

Police Scotland warn that “Around half of all subject access requests submitted to Police Scotland are from individuals seeking a copy of their ‘criminal record’.
To request your criminal record (or for confirmation that nothing is held regarding you on these systems) you should tick the Scottish Criminal History System (CHS) and/ or Police National Computer (PNC) check boxes on the application form or state in your email that you would like a CHS/ PNC check.
For all other requests it is essential that you provide as much information as possible to allow us to locate any information held - we are simply unable to research vague requests such as ‘anything Police Scotland holds’.”

Perhaps it will be enough simply to state that you want any records relating to you of a hate crime incident?
