An MSP (Murdo Fraser) threatening legal action against Police Scotland after his twitter/x post was logged as a hate incident

I couldn’t see another thread on this - just wondering if a male complaining about ‘hate incidents’ registered against him will produce a different result compared with all the female complaints that have been dismissed.

An MSP is threatening to take legal action against Police Scotland after a tweet he posted criticising the Scottish Government’s transgender policy was logged as a ‘hate incident’.
Veteran Conservative Murdo Fraser said the force had ‘behaved not just outrageously, but unlawfully’ after learning that his name appears in police files for expressing a political view.
A trans activist reported the post on X, formerly Twitter, to Police Scotland whose officers decided it did not amount to a crime but should be classed as a ‘hate incident’ which will remain on record – even though no law had been broken.

So if I say " in my opinion transwomen are men" would that be logged as a hate crime, or are opinions not allowed?

ScotGov guidance on the new legislation: It introduces new offences for threatening or abusive behaviour which is intended to stir up hatred based on prejudice towards characteristics including age, disability, religion, sexual orientation, transgender identity and variations in sex characteristics.

Given your comment/opinion wasn’t threatening or abusive, or stirring up hatred, I doubt it would be regarded as a hate crime.

I watched Trainspotting last night, and wondered how films like this will survive April 1st? The infamous Begbie 'I'm no a buftie' scene, for example, has the potential to 'offend' many. Could the TV Channel that broadcast it be reported by someone who views it in Scotland?

In fact, could a person be reported for the act of watching it on their TV? 'Ma Cousin AutumnCrow watched Trainspottin' last night ...'

Agree Douglas Ross was very effective in that clip.

Did you just call Douglas Ross “effective” 😂😂 fuck me, what is the world coming to.

I opined that Douglas Ross was very effective in that clip.

Well, don’t be fooled by that clip. Most of Scotland knows exactly what Douglas Ross is. An absolute scrote of a man.

Police Scotland being unreasonable ladies. Who'd a thunk!?

Fucking outrageous. And proves alllllll of the points that we have been making for years.

'A senior officer – titled Chief Inspector D in the PIRC report – wrote to Mr Fraser dismissing his claim that his NCHI breached the Human Rights Act, and that it represented “unlawful interference” with his right to freedom of expression.

The officer referred to the force’s Hate Crime National Guidance (HCNG), which states that “for recording purposes, the perception of the victim or any other person is the defining factor in determining whether an incident is a hate incident”.'

Literally anyone who wants to accuse someone of a Hate Incident will be obliged by the Police. Unless the person being accused is Humza Yousaf.

Ah that's right I remember the complaints at the time about Humza's 'white' speech being hateful. Watching the video in full you could see his barely held together contempt and if it had been used in the same context against any minority race then I'm sure the police would have upheld those complaints.

It's madness.

Roll on 2026 and the Scottish elections. SNP have failed on so many levels and have managed to let that failure seep into every single public body and institution in Scotland. Not one of them is actually working for people anymore. The list is endless. Police Scotland, the prison service, creative Scotland, education Scotland, the newly named historic environment Scotland, councils, charities, rape crisis centres, aid centres. I'm not really a conspiracy theory person but it's astounding how quickly and effectively these organisations have fallen, to the detriment of women and girls, children, safeguarding and basic decency and common sense. I just feel permanently depressed these days about my country.

So... is a "Hate Incident" the same as a "Non-Crime Hate Incident"? And why do "Non-Crime Hate Incidents" come under "Hate Crime National Guidance"? I'm confused about Non-Crime Hate Incidents and Hate Crimes. I wonder if the police are very confused too.

Anyway, Gawd bless JKR and her tweets which have protected so many other people from getting splattered by this shitshow.

Unfortunately, Anas Sarwar made virtually the exact same speech.
