If India really DOES have a case, India can bring a private prosecution, can't them?
I must admit IANAL, and I have only heard of these things*. I have no idea of the criteria required, but as I understand it (in my limited awareness) the CPS only likes to bring a case if they can get pretty much a definite slam-dunk, because of a) cost to the crown and b) demands on the court system.
Just because the CPS won't prosecute, it doesn't mean that a case doesn't have merit - just that they have others more pressing and egregious they'd rather go ahead with. A private prosecution with a good basis (as India insists they has) can still be brought.
I await this happening with bated breath.
