I must admit IANAL, and I have only heard of these things*. I have no idea of the criteria required, but as I understand it (in my limited awareness) the CPS only likes to bring a case if they can get pretty much a definite slam-dunk, because of a) cost to the crown and b) demands on the court system.

Just because the CPS won't prosecute, it doesn't mean that a case doesn't have merit - just that they have others more pressing and egregious they'd rather go ahead with. A private prosecution with a good basis (as India insists they has) can still be brought.

I await this happening with bated breath.

I think IW could go for a private prosecution. If, perhaps, IW set up a crowdfund or there was a no win, no fee type willing to take it. JKR obviously has the money and contacts to defend herself, but someone might take a punt for a chance of a big payout if she were to lose.

This is what happened with TRA Giuliana London who when the CPS declined to prosecute Venice Allan and Linda Bellos for malicious communications brought a private prosecution. It failed because the CPS took it over and threw it out of court.

I have a sneaking feeling that if the complaint had been made against some not very well known tweeter that the police might have done one of those long drawn out investigations as to the merit of the case, involving seizing computers etc..

But suspect even if there are a few rainbow flag wavers in Northumbria police, that the idea that they could get away with the process is the punishment tactic against JKR just wouldn't be thought possible. Knowing she would give daily updates on the "process".

However, whatever the reason they are not proceeding, ie not even compiling evidence for the CPS to decide on, could become a significant mile stone.

And hopefully more people could feel reassured about this even if the BBC thinks it can punish a presenter for referring to someone by their biological sex.
