i suspect this latest update will put a rather different slant on your perspectives on this story!

On the contrary, it makes it even worse! It's telling trans people that they can't make their own minds up about how sex and gender interact.

wontforget · 21/02/2024 21:13

so the fact that the person saying the “transphobic comments” is in fact trans… doesn’t make you just a teeny tiny skeptical and think that there may be more to this than simply someone thrown in prison for a nasty comment?!

that makes no sense. The person saying the “transphobic comments” identifies as trans!

Which is exactly my point. If transwoman A is expressing an opinion, even forcibly, that TW are male, it is outrageous that the law would punish them, just because transwoman B has a different view.

We don't do this with other minority groups, expressing opinions about their own minority. If a Chinese person says "You're not really Chinese if you were born outside of China" or a gay man says, "You're not really gay if you have ever had sex with a woman", they don't get banged up for racism/homophobia.

Have you still not managed to explain how the comments were inciting violence?

LimeViewer · 21/02/2024 21:44

The article says denying tw who haven't had surgery are women is the incitement. Sounds like a fact to me. I'd argue the tw who has had surgery is also male but can see why if you went the whole way it would piss you right off to see others lauded as brave women who barely even try.

It's still insane that anyone get 6 months in jail for making comments - even offensive ones. I don't care what sex or gender they are.

That anyone got a prison sentence for saying that there are only two sexes is madness, whoever they are.

LimeViewer · 21/02/2024 21:46

I didn't know Spain had gone so far, makes more sense of the visitor the other day!

happydappy2 · 21/02/2024 21:49

When the original link was posted, it was Woman sentenced to 6 months in jail, it now turns out it was a male…. I am so confused…and just wish journalists would report the news accurately

Other messages that were found to be criminally transphobic included her stating that “there are only two sexes,”

Good fucking grief!

Here are more of her crimes about because of which she must be re-educated:

••••Their evidence included statements she had made in opposition of the Trans Law, which was legislation recently implemented in Spain to make changing an individual’s legal name and gender marker significantly easier. The investigation also found that between February and October of 2020, the woman had posted several statements on Facebook, Instagram, and X in which she “denied transgender people without genital reassignment the gender with which they identify.”……

From what they said they didn’t know that the person imprisoned was also trans at the time of reporting.

Myalternate · 21/02/2024 21:55

Boys will be boys….🤣

Transgender person writes that the other transgender person isn’t ermm..transgender!

Why isn’t ’the law’, which is supposed to be about Truth, calling men, men? We are living in a world where the law itself, is lying to everybody. How are we supposed think the law can ever bring justice?

Calling a man a woman they might as well say guilty is not guilty. Or black is white. I’d like to see a court case where the law makes its own case for telling us men are women.

I agree, and watch them swear in that they’ll tell the whole truth and nothing but the truth.

Flickersy · 21/02/2024 21:59

I think this goes beyond simply making statements on social media. It sounds like harassment, which of course should be punished.

ArabellaScott · 21/02/2024 21:59

Without Maya Forstater we.may well be in this situation ourselves.

Scottish Mumsnetters await this scenario as soon as the Police work out how to implement the Hate Crime Bill. Which as we've established has no criteria or threshhold at all.

pickledandpuzzled · 21/02/2024 22:02

Argument between two men about which of them is the better woman gets out of hand.

nauticant · 21/02/2024 22:08

Apparently further clarification:

SPAIN-BARCELONA: A woman was sentenced to 6 MONTHS IN PRISON for making "transphobic" social media posts in 2020. The execution of her sentence was then suspended for 2 yrs, provided she doesn't commit another crime, pays €3,850 in "moral damages" & takes a course on "equal treatment & non-discrimination." Links follow.

My observation is when it comes to events in the worlds of trans people, the reporting seems to be unclear, muddled, and full of holes. I wonder why that would be?

PriOn1 · 21/02/2024 22:13

I’m guessing the private information revealed was about the lack of genital surgery.

It’s not as if anyone could mistake the sex in this case.

But I note that the many questions about the claims of inciting violence have been carefully swerved. Anyone noting that might conclude that it was made up, but I would love that assumption to be proved wrong. Nobody should be sent to prison for their opinions on this.

LimeViewer · 21/02/2024 22:14

So really a fine and a course. Like getting a speeding ticket but more expensive. And watch what they say for 2 yrs or they'll go to prison for 6 months.

Boiledbeetle · 21/02/2024 22:33

Well the new information just makes this while thing seem more bonkers!

A suspended prison sentence is nothing like a speeding ticket.

OvaHere · 21/02/2024 22:50

I did think the language used in the offending posts didn't sound like a woman.

So it makes more sense that this is an argument between men about who has the bigger claim to being a woman.

IcakethereforeIam · 22/02/2024 00:51

A lack of dick measuring contest.

Utterly insane 😳
