And Sturgeon has really shot herself in the foot here (again). Because if she really thinks 'trans women are women', why is she not allowing this 'woman' to go to a female prison?

So therefore she knows this person is not a woman.

How is it that it's so easy to know what a woman is when deciding which prison to send a rapist to, and so complicated when explaining why said rapist belongs there?

The thing is, this is not how safeguarding works. This scenario was raised to her I'm sure and she dismissed it. Do there have to be multiple issues brought to the fore - notably also children being operated on and then sorely regretting it and asking why was there no gatekeeping?

Scotland wants to give green light in 3 months to any many who says they're a woman, no diagnosis or medication needed.

@MrsPutnamNaomiDarling Isla Bryson doesn’t have a GRC as far as we know ie it wasn’t referred to during the trial so the supposition is that he doesn’t as his defence was more than happy to rely on his transition to suggest an acquittal was appropriate.

Following the Haldane judgement, having a GRC means an individual is treating as being of the opposite sex for all purposes ie EA exemptions would no longer apply as a trans woman would be considered female so single-sex exemptions couldn’t be applied.

So, £5 and 3 months means a rapist would have the legally enforceable right to be housed in a female prison as they are “female” and any rules, policy, laws (? not sure on that one) denying that right would be discriminatory.

Now, as the Haldane judgement is just that, it can be overturned/superseded or legislation could be enforced to negate the impact of “for all purposes”, but as the SG declined to legislate to prevent people on trial for rape being granted a GRC it’s highly unlikely they’d go that far.

As an aside, if “for all purposes” stands then trans men holding a GRC would theoretically be unable to access female only legislative protection ie maternity leave, maternity pay.

Quite the shitshow conundrum.
