Can anyone make an educated guess what’s going on? Is it Marion’s human rights that are under consideration? (I fucking hope so!) Why wouldn’t she be allowed to make a statement?

NonnyMouse1337 · 31/08/2021 12:24

Is the human rights angle a good thing?

Yes, Marion's.

She made no plea, and the case was continued for a hearing on 4th October so that the Court can consider a number of preliminary legal issues including the compatibility of this prosecution with Ms Millar’s human rights under the European Convention of Human Rights. Since this case is sub judice, MM will not be making any statements at this time.

Nice to see Julie Bindel tweeting support. Sadistic is right.

Presumably if they are considering a human rights angle then this is to do with freedom of opinion and expression and whether or not the case is compatible with Marion's freedom to express herself. If it is found not to be compatible with MM's human rights I'm assuming it would be dropped. Although I could be way off the mark!

Articles 9, 10 and 11:

Cailleach1 · 31/08/2021 12:43

She should be looking for compo and an official apology.

timeisnotaline · 31/08/2021 12:43

I would love to understand what’s going on and what these claims are!

yourhairiswinterfire · 31/08/2021 12:45

@Cailleach1

She should be looking for compo and an official apology.
Hopefully that'll be how this complete shit show ends.
Jaysmith71 · 31/08/2021 12:49

This being a criminal case, any costs awarded would be footed by the poor sod taxpayer.

WarriorN · 31/08/2021 12:52

This is the latest updates I've seen

Ha sorry, 45 mins too late! Ignore

SimonedeBeauvoirscat · 31/08/2021 12:53

I thought this article explained it quite well:

www.heraldscotland.com/politics/19547978.scots-feminist-hate-crime-case-continued-consider-human-rights-issues/

It sounds like a good thing although the wait must be agonising. Obviously the police have failed to consider her human rights. Hopefully this means the court will now do so.

ItsAllGoingToBeFine · 31/08/2021 12:58

From that piece:

Today Marion Millar attended court and for the first time received a copy of the Crown's complaint setting out the charges against her

Is it just me or is that really unfair? Is it usual to not know what you have been charged with until this stage?

Itsinthetreesitscoming · 31/08/2021 13:00

Sending solidarity to Marion.

I would imagine this is all pretty baffling for people who haven't really followed the case - putting up ribbons in suffragette colours is considered a crime???

Cailleach1 · 31/08/2021 13:00

Think of all the misuse of public funding that is going on persecuting women for standing up for our rights, or the misuse of public funds damaging the next generation. If this case ends the harassment of Marion (and other women) stops that, It would be cheap at the price. You'd save public money and it wouldn't be used on damaging lives.

Maybe they could then start policing domestic abuse and violence against women. I know it is nowhere as important as the whims of men, but we could be cheeky and ask the police to protect the limbs and lives of women.

Nowhere as important and real as the inner feelings or notions of men, I understand.

Yes. It's really not a case of them dragging out the case to punish her.

That was to Jaysmith71's post.

It is doubly scandalous that they are funding the state persecution and harassment against women.

Masdintle · 31/08/2021 13:09

I'd like to know what the case against her actually entails. It seems so weird to me that she has only just discovered the nature of the charges and their content.

I might take a wee day trip to stand in solidarity with my Scottish sisters on 4 October.

Jaysmith71 · 31/08/2021 13:10

....and the decsion to prosecute is not for the police but the COPFS, who say they want to prioritise serious crime, violence and drug-dealing.

SpindleWhorl · 31/08/2021 13:10

As well as the Police, you have to ask what the Crown Office and Procurator Fiscal Service (COPFS) is bloody playing at.

Thank god the court listened to the arguments (presumably Joanna Cherry's?) that MM has likely had her own human rights interfered with, and will now go away and seriously consider this.

It's a very good development, I personally think.

MorrisZapp · 31/08/2021 13:11

What are the charges? Are they now public?

WarriorN · 31/08/2021 13:12

Yes. It's Kafkaesque. Did they read out her tweets in court? Why do we still not know what was in the supposedly offensive tweets?

ItsAllGoingToBeFine · 31/08/2021 13:13

In (my opinion) related news, a tragic tweet from the man who felt so threatened by a ribbon that he started all of this:

"So I've made quite a big and difficult decision.

I've decided to leave Scotland, in part because I no longer felt safe in my home.

I love Scotland, and I've so much love for Glasgow. I think Scotland has an amazing future. I just have to do what's right for me and my wellbeing."
