I don’t know, but I suspect and hope that this is a case where rape is the charge and the offence is what a layman would describe differently. Look away if you’re squeamish (although I’m not about to describe anything worse than anyone would imagine) Rape is putting a penis in an orifice without the victims consent, that’s why women can’t be prosecuted for rape. A man could technically be prosecuted for rape if he’d dick slapped a woman in her open mouth. I am not saying thats ok or not deserving of punishment but it’s not the same as penetrative sex. A 14 year old was prosecuted for rape when a 13 year old gave him a blow job. Teachers overheard other kids chatting about it and had to report. It got all the way to crown court. Again I am not saying that’s ok but it’s not what most of us would imagine to be rape.

I hope this doesn't set a precedent for the going rate, to rape a child in the UK to be £2,700 and a slap on the wrist. I feel ill.

@SorryAuntLydia I’m mortified.
This sentence is horrific and like others I’m struggling to understand why it was so low. The fact that rape as a crime covers more than piv sex might be why the sentence is lower and would explain why. I don’t understand why he wasn’t given a custodial sentence even if it was a situation like I described. I would have thought an explanation where the situation was less horrific than we’d assume when hearing the word rape would be the ‘best’ scenario.

Lydia for goodness sake 🙄 equinox is providing you with a summary of the law. She is not giving her opinion, she is providing fact on the differences in law.
OK so same question to you then: which orifice on a five year old child do you think it’s ok to put a penis into? so that it would be a form of mitigation?

It has to be the only explanation- that and his mental capacity and/ or it being a very historic offence ie he was under 10, but that sounds unlikely from the mother’s comments.
If not, that judge needs stringing up sacking.

How is someone with severe enough LDs to 'excuse' raping a little girl expected to pay £2500 in fines? That (amongst the ridiculousness of it all) seems bizarre? Is it £1 a week for years and years?
Either he has capacity to pay the fine, stand trial and be imprisoned or he needs to be in a secure unit.

I’m sorry for your experience.

And no I do understand mitigation. There is no mitigation in the sentencing guidelines based on the guilty party using a different orifice (nor should there be) so speculation about exactly how this little girl was raped is at best distasteful.

@Etinox thanks for the explanation. But as I’m sure you are aware we get some interesting visitors in these parts. And this case is not one of a 16 year old boy and his 15 year old girlfriend, far from it.

The system is supposed to

Rehabilitate
Show justice is done
Protect the public

I would say.

The amount of people hazarding guesses as to why it's a perfectly reasonable thing to get no jail time for raping a 5yo.. why?

Oh maybe it happened years ago
Oh maybe it was a dick slap (???)
Oh maybe he lacks capacity (so why on trial???)

Or maybe. It's an unduly lenient sentence.

If the guy lacks capacity to understand why raping a 5yo is wrong then he is dangerous.

If he doesn't and he raped a 5yo then he is dangerous.

Prison or mental health place. Protect the public. Where is that.

5 yo fgs. People saying oh maybe it was 10 years ago. So he was... 11. And raped a 5 yo. That is still very very much not ok.

It's gross isn't it? She's going to have to live with this for the rest of her life. If the little girl lives to be 80, that works out at £2 per month for her lifetime of torment and trauma. Meanwhile, the person who inflicted this on her is walking free already. It's enough to make you lose all faith in the justice system.

We don't know - almost no information has been published yet.

I wonder if perhaps there are other cases still being investigated or heard in relation to this one. Might explain why almost no pertinent information is being released and why so few media outlets are covering this.
