Both Independent and Times carrying story on their front page.

This is going to backfire spectacularly.

What the actual fuck?

Badgerthebodger · 28/04/2019 23:22

Oh Christ. I’ve got no fucking words anymore. Something has gone inherently wrong that this was even considered, never mind put into practice. Yes, give us your phone so we can make sure you’re the “right” kind of rape victim before we waste money pursuing the case. Wouldn’t want to waste time and money pursuing cases where the victim was drunk, had had prior contact with the disgusting rapist or probably a million other reasons they will find not to pursue the case. I am so fucking ANGRY Angry

stillathing · 28/04/2019 23:23

The police badly need better training on rape, sexism and women.

RedToothBrush · 28/04/2019 23:23

Yeah quite.

Whoever had this bright idea is going to get rinsed for its sheer stupidity.

Fantastic. What a good idea, since the evidence is so important to gather!

Next, let's make sure that if your car is vandalized, you are required to turn your car into the police if you want to file a report.

Did someone assault you on public transit? They'll be needing your transit pass if you want to report it. For...research.

After that, if you report that someone's stolen some things from your home, the police will need to take your house off your hands for a while so they can look into it more thoroughly.

Seriously, though, this goes to show how rape is treated VERY differently from other crimes. If you claimed someone on a classified website had given you bad merchandise or otherwise defrauded you, would the police start by asking for your phone so they could make absolutely certain you weren't trying to get revenge on some beleaguered man you're accusing of fraud? Never. If you'd come to report a theft in your home by an ex, would the police demand your phone to make sure you hadn't agreed to give him the items he stole? Maybe you're just trying to ruin his life!

MrsSchadenfreude · 28/04/2019 23:29

DD2 was sexually assaulted and had to let the police have access to her phone. It was to make sure she hadn’t been discussing the case with his other four victims. Unsurprisingly he got let off, because a nicely brought up young man can’t possibly be guilty.

Smotheroffive · 28/04/2019 23:31

Why is so much money put into wasted on searching for other ways of berating and defiling women.

Why the continued search for just something/anything irrelevant to try to blame for woman for the attack.

Why does this still happen, its so gross.

What does rape have to do with anything said or done beforehand?

Why are so-called professionals paid so much to be so deliberately ignorant

Angry
Smotheroffive · 28/04/2019 23:34

His other four victims so sorry for your DD, and his other victims. They commonly get off, its so utterly soul destroying, especially after having to relive it all through a court trial. Flowers

Wrt the phone records revealing case

SarahTancredi · 28/04/2019 23:39

Why on earth do they need the phone.

Doesnt matter what was said or done before hand. Why are the victims being treated like the criminal.here.

Even if there were plans to meet up and exchange of dirty texts and pictures or whatever that doesnt mean that that no she said half way through can be ignored.

People have the right to say stop at any time. Failure to stop at that point is rape.

Anything on that phone is irrelevant.

Plus it's also well known that the majority of rapes are by people you know. So of course there will be communications between the parties concerned.

From 2018;
''Rape victims’ mobile phones will not be seized ‘as a matter of course’, new director of public prosecutions says''
Max Hill QC says police and prosecutors must ‘avoid unnecessary intrusion into a complainants’ personal life’

Badgerthebodger · 28/04/2019 23:44

MrsSchadenfreude I’m so sorry for your DD Flowers I am absolutely horrified that the police see rape victims as responsible for their own rape. That’s what it amounts to isn’t it, these women and girls obviously did or said something to deserve it so they need the phone to prove that. Utterly disgusting.

Redshoeblueshoe · 28/04/2019 23:47

This is currently being discussed on Sky News review of the papers.

I hope I didn't disturb my neighbours with my reaction.

It was loud, and contained an awful lot of swear words !

SarahTancredi · 28/04/2019 23:49

So few rapes etc are reported as it is.

The stats for those resulting in a prosecution are dismal.

Peoples whole lives are on their phones. No one will want to hand them over. So even fewer rapes will be reported now they intend to violate the victim even further Angry

Guess they can tell the powers that be that whatevervictim blaming rape prevention campaign they are running is working as there will be fewer reports. Makes them look good I guess.Angry

Datun · 28/04/2019 23:49

Well that's a green light to any would be rapist. Start chatting someone up, get a bit flirty on the phone, and then rape them with impunity.

Redshoeblueshoe · 28/04/2019 23:50

I am so glad that my DDs are already adults.
I think parenting teens must be really hard at this moment in time.

TheInebriati · 28/04/2019 23:51

Well they can already kill their date and claim it was BDSM sex gone wrong.

Raggerty54 · 28/04/2019 23:52

A girl I used to work with was sexually harassed by a co-worker at a social gathering. She had to hand her phone over to the police to ‘investigate’.

OccasionalKite · 28/04/2019 23:53

Are men accused of rape also "told to give police access to phones"?

TheInebriati · 28/04/2019 23:53

No, just the victims.

OccasionalKite · 28/04/2019 23:58

Just glad I found MN.

Because this is grim.

Smotheroffive · 29/04/2019 00:11

Watch Goat!!

This is how young men in frat houses are carrying on!

What chance in 2019 of change?

This is crisis

Blondieg · 29/04/2019 00:12

Redstone, anyone can be raped, not just teenage girls.
Disappointing news, hope it doesn't come to fruition

Smotheroffive · 29/04/2019 00:16

Yep, all ages.

There's need to be a ban on trying to discredit sa victims

TheInebriati · 29/04/2019 00:18

''Police and prosecutors say the forms are an attempt to plug a gap in the law, which cannot force complainants or witnesses to disclose their phones, laptops, tablets and smart watches.''

www.itv.com/news/2019-04-29/rape-victims-must-hand-over-phones-or-prosecutions-may-not-go-ahead-police/

I don't see how a consent form can override the law, especially if it is used with a threat (to drop the investigation), or if it means physical evidence is ignored.

Badgerthebodger · 29/04/2019 00:21

No of course the accused don’t have to give up their phones for full and thorough investigation Angry they’re also allowed to have their victim extensively cross-examined on the stand, just like someone accused of a crime, by their hostile barristers. Barristers of course just doing their job but I see no reason why the victim of a rape should have to take the stand and submit to cross-examination. It’s fucked. Just utterly fucked. No wonder reporting is so low. Would you? Would you advise a friend to? Or a daughter? I bloody wouldn’t. I’d say, I will support you in whatever avenue you decide, but if you choose to heal in your own way, without having it raked up in court, I will support you in that and you will not be judged. Horrible.
