I didn't realise Miranda Yardley was in court today over alleged transphobic harrasment.

At Basildon Magistrates Court where Miranda Yardley is on trial for transphobic Harassment. The prosecution applied for reporting restrictions to prevent the complainant Helen Islan from being named. The judge has not granted them. So Helen Islan can be named.

Could not be more pleased about this for Miranda. What an utter waste of everyone's time, though, and it must have been very grim for Miranda waiting for this to get to court over the last few weeks/months.

Hope they're now ensconced in the pub celebrating.

I’m curious — does this case set any kind of legal precedent?

It would be nice to think that judges will take note even if it is not an official legal precedent and treat other vexatious litigants accordingly.

Surely the CPS have a review procedure for examining what has gone wrong when cases are thrown out like this? After all, it doesn’t happen often.

Miranda says:

10 months of attempted prosecution for anti-transgender hate crime and harassment. Initially the charges were Malicious Communications and Section 2 harassment.

A day being interviewed by police. Police then turned up at Miranda's house and demanded Miranda have fingerprints taken.

MY has attended court 3 times in relation to this. Was in court in October. Then Monday in Chelmsford.

Fwiw re legal definition of harassment

(2)For the purposes of this section [F2or section 2A(2)(c)], the person whose course of conduct is in question ought to know that it amounts to [F3 or involves] harassment of another if a reasonable person in possession of the same information would think the course of conduct amounted to harassment of the other.
(3)Subsection (1) [F4or (1A)] does not apply to a course of conduct if the person who pursued it shows—
(a)that it was pursued for the purpose of preventing or detecting crime,
(b)that it was pursued under any enactment or rule of law or to comply with any condition or requirement imposed by any person under any enactment, or
(c)that in the particular circumstances the pursuit of the course of conduct was reasonable.

We've had Venice, Linda, Posie (twice, I believe), Maria Mac, Miranda, glinner, Scottow - all being accused of transphobic crimes.

None of which hold up.

I suspect TELI need to reassess their raison d'etre. Because, as they are swiftly finding out, reality is not a crime.

As another aside Lord Moonie could be the next defendant we are all cheering on as AC recently spent a day at a police station reporting him for something or other.
