I didn't realise Miranda Yardley was in court today over alleged transphobic harrasment.

Debbie Hayton
@DebbieHayton
At Basildon Magistrates Court where Miranda Yardley is on trial for transphobic Harassment. The prosecution applied for reporting restrictions to prevent the complainant Helen Islan from being named. The judge has not granted them. So Helen Islan can be named.

Sending Miranda good luck vibes.

And the comments this morning about the judge asking the lawyer to ask their client if they were sure they wanted to go ahead.

Knicknackpaddyflak · 01/03/2019 16:22

I'd think it'll set a strong CPS precedent. It also sends a clear message to police, it's not the first case dismissed or thrown out where it's ended in utter public embarrassment for the professionals who stood behind it.

Please don't mis-entry MN MsJemimaPuddleduck! Shock

This isn't a rabbit hole, it's a radicalisation portal

I haven't really been following this. Is this Helen as in 'Mimmymum' on Twitter, with the mermaid avatar?

I also don't understand how it could get to court if there is 'no evidence'?

Anyway, really pleased for Miranda. Sanity prevails for now!

Melroses · 01/03/2019 16:23

Poor judge. Decades of studying law and had to spend an afternoon dealing with the kind of wittering the average lunchtime supervisor in a primary school playground sorts out on daily basis.

I am feeling sorry for all the teachers and lunch time supervisors. I had forgotten about this sort of crap that they have to deal with.

AngelaHodgeson · 01/03/2019 16:23

People found not guilty don't get their costs paid.

Sometimes they do if the prosecution has made a serious error or omission when bringing the case. It seems that "no evidence, no case to answer" should mean that a serious error has been made by the CPS here.

missedith01 · 01/03/2019 16:24

It's too low down the court hierarchy to set precedent, I think.

I wonder if the CPS will make a statement.

McTufty · 01/03/2019 16:25

morskie I know it sounds more civil but the inside of the court building Miranda is in looks like the magistrates to me. Plus usually wouldn’t throw out a civil case at half time in that way. But it’s all very unclear.

SingeBuggerCack · 01/03/2019 16:26

Thanks blue and Edith. I had a feeling it wasn’t quite important enough, but wasn’t sure.

truthisarevolutionaryact · 01/03/2019 16:28

Excellent news.
The CPS and various police forces must be made to stand back and acknowledge that their use of lobby groups like Mermaids, GIRES etc to "train" them in the views and wishes of such organisations has impacted on their neutrality. They have been weaponised by these groups and are no longer independent.
There's a long list of examples where police officers have carried out the orders of Mermaids and harassed citizens. (Where's R0wan when you need her?) The CPS are civil servants and we now know how women are being harassed there by men:

Well done MirandaFlowers. Nice to see common sense prevailing.

Amoregentlemanlikemanner · 01/03/2019 16:28

... are magistrates' court cases even reported ever?

[wish I'd studied harder...]

MrsTerryPratcett · 01/03/2019 16:29

The courts use the law, they don’t fuck about with feels.

You'd really think the CPS would know that.

ContessaIsOnADietDammit · 01/03/2019 16:29

Just read this through from beginning to end! Hurrah for Miranda Smile

ItsAllGoingToBeFine · 01/03/2019 16:30

Given that at least two journalists were there I hope so ....

nettie434 · 01/03/2019 16:30

ChesterGreySideboard
It's interesting that someone in a same sex relationship is unaware of the trans movement.
I have seen a few tweets from Emma Kennedy that suggest she is quite GC. I'm thinking of buying one of her novels after I've downloaded some of Zuby's music. Grin

hackmum · 01/03/2019 16:32

If this case really was brought by the CPS, then they're going to have some pretty serious questions to answer. This is an absolutely shocking waste of public money - as well as being morally indefensible.

By the way, this was a magistrate, so won't have spent years at law school or training to be a judge. Just an ordinary Joe/Jo offering common sense.

hackmum · 01/03/2019 16:33

... are magistrates' court cases even reported ever?

Yes - the Mail reported the malicious prosecution of Linda Bellos and Venice Allan.

Popchyk · 01/03/2019 16:33

I hope Miranda comes on here and gives us the lowdown.

I have a lot of questions. Smile

nettie434 · 01/03/2019 16:33

Should have added this is great news for Miranda (who is amazing) and may stop some of the horrific harassment of people who have politely and not at all transphobically questioned TRA bullying

Lysistrataknowsherstuff · 01/03/2019 16:34

Amore All magistrates courts used to be reported by the local paper, but most aren't covered by the press anymore unless a case of significance happens.

Datun · 01/03/2019 16:34

I hope someone like Joani can come on and to tell us exactly what the evidence was being presented, and why.

The actual details of what the magistrate said constituted no evidence, would be very useful.

Datun · 01/03/2019 16:34

Or Miranda of course !

ItsAllGoingToBeFine · 01/03/2019 16:35

Our favourite self IDd lawyer chucks Islan under the bus...

Whist not knowing all the specifics about the #Yardley case I do know that if a criminal matter is kicked out at 'half time' there are serious questions to be asked as to how the matter got near a court room. The elements of the offence simply were not there.
