Such situations raise serious questions. How far can an individual make drastic changes in policy in a national service (police/teaching/government/NHS ) with no oversight or consensus?
Should we be aiming to agree with a more right-wing analysis that the entire concept of hate crime that the State has an interest in prosecuting is flawed?
This is a difficult one. I can see how hate crime legislation is being abused. But there first must be an actual crime, and that crime must be deemed driven by hate (is that right?) I think the problem is that what’s being reported isn’t a crime in the first place. Hate crime legislation isn’t designed to stop people having opinions others disagree with or upsetting people - it’s supposed to be about crimes.
If you slag off the church of the Flying Spaghetti Monster online you’re not committing a hate crime.
If you burn down the church of the FSM you are committing a hate crime. A crime (arson) motivated by hate (of His Noodly Goodness.)
