Lily Madigan - Twitter Update

DarthArts · 07/04/2018 20:43

LM has changed the name of their twitter account, deleted all previous posting history and unblocked lots of users.

Has tweeted (in response to someone else) that non-one has spoken to them about online behaviour.

LM did get in a twitter spat after comparing trans struggles to racism and slavery and got a lot of previous supporters complaining. LM did issue a twitter apology about this then took a twitter break and has resurfaced with this new "clean" account.

@Madigan_lils

So not sure what's happened here.

I would hope maybe a degree of self reflection.

As ever, let's make sure any posts are not offensive please.

Ms Madigan has reposted their block list. Did anyone ever get a response on Data Protection?

Thanksforthatamazingpost · 13/04/2018 12:32

TheVastMajority

You should call the ICO and ask them direct.
(for myself I don't think it's a GDPR issue but I may be wrong).

But there may be other issues.

Ereshkigal · 14/04/2018 13:57

Email addresses are considered personal data under the GDPR so I imagine non anonymous twitter handles would be. If that's you, I would send a letter formally asking to be removed from the list as you can be identified and copy to Labour compliance and the CLP.

But they aren't identifying.

There are many people with the same name.

Ereshkigal · 14/04/2018 14:34

Yes, but that's fundamental to data protection legislation, even though lots of people have the same name. Rape victims can't be identified by name, even though lots of people share the same name.

Ereshkigal · 14/04/2018 14:38

Some people tweet in their personal name and use it for work things etc. They may just have liked a mildly GC tweet or Facebook post or follow people deemed "transphobic".

yetanothertranswoman · 14/04/2018 14:54

I wonder if a list of transwomen on a website also comes under GDPR?

Especially if their previous status is disclosed?

Kropotkinator · 14/04/2018 15:16

The GDPR is specific to companies. A company should only hold data about you that is significant or relates to business interests specifically in order to carry out goods and services. They cannot use it for any other purpose apart from the reason for which it was gathered in the first place.

If madigan is tweeting in a personal capacity the GDPR doesn't apply as it's specific to business. If Madigan was to use the list as part of his role in the Labour Party, without the consent of the data subject then the organisation would be liable for a fine of up to 20 million euros or 4% of global turnover.

This applies to companies and not individuals so you would have to prove that Madigans account is not personal, or that they are using it in the Labour Party and have got it without consent.

This is a new law and it's ambiguous. The law in in force from 25th of May. I expect there will be a lot of test cases.

Ereshkigal · 14/04/2018 15:31

That's the only bit I'm not sure about. It's not just "companies", its organisations/data processors and controllers in general. But how far is someone like Madigan a representative of Labour?

LizzieSiddal · 14/04/2018 16:40

I think an email to LabourHQ, detailing what LM has done, and a mention of the new law, will make labour pay attention.

Thanksforthatamazingpost · 14/04/2018 19:11

“The GDPR is specific to companies”

I know that is not right.

Thanksforthatamazingpost · 14/04/2018 19:14

Personal data? Yes
Within special category? Yes (ditto for your query trans woman)

Personal data being processed? Certainly

Data controller is who?
Lily is a data processor.

I don’t think this is just a hobby...

I may have been wrong.

Gosh I would almost say this makes GDPR interesting....

BlackeyedSusan · 14/04/2018 19:30

Churches and GP surgeries are having to ask for written permission to continue using your data, eg text reminders for appointments.

Thanksforthatamazingpost · 14/04/2018 19:44

.?? What?

I suppose that as half the population have become GDPR consultants they have to tell people to do stuff :)

sorenipples · 14/04/2018 20:22

I have read on the twitter feed "The life expectancy of a transgender woman of colour is 35 years-old. It's driven this low by the combination of racism and transmisogyny."

Obviously if this life expectancy is correct it is terrible, even more shocking if the root cause analysis is accurate, but it sounds so shocking it needs a fact check. Does anyone know the source of this ? Does it refer to the UK? (I have read that south American statistics are often quoted) obviously this is a tragic statistic wherever in the world it applies to.

Ereshkigal · 14/04/2018 20:28

It's not true. Anywhere.

sorenipples · 14/04/2018 21:12

I see this had been addressed before www.mumsnet.com/Talk/womens_rights/3070105-Fake-stats-transgender-life-expectancy

An interesting thing to tweet on a twitter account linked to a personal pay pal account just before complaining about NHS waiting times and the potential need to go private

Ekphrasis · 14/04/2018 21:33

I think screen shots might be useful, of block list etc?

MrGHardy · 14/04/2018 23:28

"I would hope maybe a degree of self reflection."

More like realized people won't continue supporting the trash he kept writing.
