H&M vs Backgrid

H&M have apparently ’demanded’ pap footage from Backgrid, according to TMZ.

Their lawyer has replied with the following:

In America, as I'm sure you know, property belongs to the owner of it: Third parties cannot just demand it be given to them, as perhaps Kings can do. Perhaps you should sit down with your client and advise them that his English rules of royal prerogative to demand that the citizenry hand over their property to the Crown were rejected by this country long ago. We stand by our founding fathers

Prince Harry and Meghan Markle Demand Photo Agency Give Them Footage of 'Chase'

Prince Harry and Meghan Markle are trying to put the squeeze on a photo agency that claimed their freelance paparazzi who followed the couple Tuesday night were not, as M&H claimed, "highly aggressive" and didn't cause a near-collision.

Bit of a snarky reply. As far as I'm aware H&M wouldn't be able to 'demand' British photographers hand over material either!
But if they did nothing wrong, I don't see why they wouldn't want to prove it by putting their footage in the public domain

Yea I thought it was an excess of snark too 😂. Presumably, Backgrid don’t want to hand over the footage as they want to make money out of it 🤷‍♀️

pussycatinfluffyslippers · 18/05/2023 21:00

You'd think that in the Land of the Free and the Home of the Brave where you can chuck a lawsuit around willy-nilly there would be Dashcam footage from H and Ms car...

PicturesOfDogs · 18/05/2023 21:03

Do we reckon they asked for it first?

Seems a bit heavy handed to get lawyers to write a letter demanding footage.

Particularly when they know there’s no legal right to do so, considering Meghan had her own successful copyright claim.

It seems likes it’s turning into a bit of a PR disaster for them

Maybe they are finding reasons to back track from having to substantiate 'nearly catastrophic'?

WinnieTheW0rm · 18/05/2023 21:09

I quite like the response! It probably comes across quite differently to the British reader, who will know that the monarch can't just demand stuff like that (and that therefore its a tease) and non-British who perhaps might take it more literally

ImAvingOops · 18/05/2023 21:20

I think deliberate misrepresentation of UK law is shady behaviour

Fuck me! That is some slap in the face comment!

polkadotdalmation · 18/05/2023 22:01

I wonder what the police bill will be for the police escort? It looked like some photographers were taking photographs of them in a taxi. They moved away when asked, and sounded respectful.

YouWonJayne · 18/05/2023 23:23

I don’t think they’re being unreasonable asking for the footage - the press are happy to make a quick buck out of them and harass them but won’t consider a bit of give and take. No matter your views on H&M this smacks of greed and nastiness

YouWonJayne · 18/05/2023 23:25

Also I find this American snark towards British quite embarrassing - like when they do the tea drinking insult. Like we give a shiny shite 😂 they’re a mess of a country and frankly I’d be borrowed if they ever wanted to ally with us in any way. The ‘wah wah English we won the war’ makes me cringe so much I’m turning inside out

Thats what I said I wonder if they asked.

Sending the lawyers in with ‘demands’ seems heavy handed, and unlikely to illicit ‘a bit of give and take’. You catch more bees with honey than vinegar and all that.

I presume the only people whose demands for footage will be listened to, is the NYPD.

I'm sure that Backgrid don't want to share the footage because they're protecting their paps (and themselves).

GrimDamnFanjo · 19/05/2023 00:48

I thought Backgrid were the paps you invite to invade your privacy?

YouCantTunaFish · 19/05/2023 00:59

Don't they employ backgrid to take their um er umm (official / staged)photos? 🙊Wink

AliceOlive · 19/05/2023 02:47

It’s a dumb and unprofessional reply to a ridiculous “demand”. Clowns to the left, jokers to the right.

Whenharrymetsmelly · 19/05/2023 03:16

What a fabulous response from the lawyer, ouch 🤣

WitchBores · 19/05/2023 05:02

😂It's a sarcastic response to a preposterous demand, it's silly but amusing.
H&M are intent on being ridiculous and are constantly undermining themselves and brand Sussex. They might yet find their feet but in the meantime their particular mix of cultural and social backgrounds isn't fusing very successfully, which affects their public images badly.

Meghan is prone to drama and her values are for show and Harry is an entitled prince who may mean well but is neither street smart nor accomplished. Both have abandonment issues (Meghan's mum left her to live alone with her dad when she was a young teenager). This particular mix of victimhood and entitledness and not having or following expert advise is currently their downfall. They both massively over estimate themselves.

Somehow, with all their silliness, I hope it will work out alright for them.

I agree. It's a response aimed at amusing the internet. But I also don't know why H&M would demand the photos/videos - the police are investigating the incident aren't they, so they can presumably require stuff be handed over without any need for H&M to be involved. And even if the police weren't investigating, celebrities can't demand that pictures of them be handed over.
Backgrid should employ some grown ups though.

ZenNudist · 19/05/2023 06:36

I don't like H&M but backgrid come across as ignorant and like they have a centuries old chip on their shoulder.

Effieswig · 19/05/2023 06:46

The response is deigned to make fun of H&M. It definitely plays to American audiences.

I don’t think it’s particularly clever or witty. It’s a bit daft.

I am, out of nosiness, wondering why H&M want the footage. Harry appeared to get a lot himself which would prove his claims of a ‘near catastrophic’ chase.

I can’t help wonder if, to Harry, in the moment it felt really awful. But looking back at the footage it doesn’t appear to be as bad as the statement made out and they are hoping to find more in backgrids footage to back up the statement.

Maybe if Harry had waited a few hours, the statement would have used very different wording and maybe not a sensationalist.

sashagabadon · 19/05/2023 06:52

Harry is getting very bad advice atm I think.
never complain never explain has it’s benefits. The opposite has many downsides not least making enemies of every one.

sashagabadon · 19/05/2023 06:54

Backgrid look shit too but they are playing to an American audience that laps up all the we kicked out the monarchy in 1776 ( or whenever)

sashagabadon · 19/05/2023 06:58

I am back to feeling very sorry for Harry again. Yes he is an idiot but he is in a mess.

ThePoshUns · 19/05/2023 07:03

Doesn't Meghan invite backgrid to photograph her staged pap photos? Awkward.
