@LinaKarimRayan1993 I can’t believe it he always had high care rate went to low rate care so done a MR and stopped everything I’m gonna struggle even more now I had all reports from docs which would prove his care needs and one from mobility and stopped everythink from 13th October so won’t get his next payment but the call from decision maker went so well too and she thanked me for all his evidence xxx

Oh hun, I'm so sorry that this has happened to you, its absolutely disgusting that they can do this to people. You weren't asking for them to reconsider his needs lower, you were saying they've increased. I agree with what @LinaKarimRayan1993 has said, fight it and take it to tribunal, I know it might seem like a million miles away, but you've done amazing so far and you've got this. They are horrendous people and I don't think they should be able to just make decisions like that without discussing it with us first.
Call back and say it is going to put you in financial hardship and you want it escalating and contact your local MP and see if they can help as well.
I'm so nervous that this is going to happen to me. I put that his care needs haven't changed and I'm panicking they will reduce his care.

Thanks ladies I will fight it I suffer with really bad anxiety too but to stop everythink really upset me my little boy is five can’t believe this really can’t stop crying xxx

I'm so sorry to hear this, it must have come a such a shock! I know it feels exhausting but do continue to fight for your sons needs. Has anything changed support wise/medication wise since your son was first awarded HRC?

NC - forms requested 23/07, scan date 04/09. Back pay received today - calculates to 12 weeks MRC.
6 weeks from scan date to back pay hitting bank.

Just catching up on thread, that makes no sense, too award HRC for a period of time and then drop it to LRC at renewal and then at MR to decide that even the LRC threshold isnt met is absurd.. Thats 3 different decision makers with 3 completely different perspectives on the form and evidence and rates.
Take the weekend to be upset and to feel sad for your child and as soon as you get the MR notice through the post file at the first tier for tribunal i understand you have anxiety and that may seem overwhelming for you but atleast if you file it then DLA have to respond and there is a chance they will overturn the complete decline now and award some rates and backdate it way way before a hearing is even listed, they can actually overturn at any point right upto the hearing and lots get awards within the first 4 weeks of filing for tribunal so chances are you wouldn't even need a hearing, if you decide to pull out of the hearing later on down the line cause you cant cope with a hearing then do that but please file for one and give DLA a chance to overturn, they will have to justify how the first DM says HRC the second says LRC and the third says child doesn't qualify at all... Its very rare to drop it down twice 😭

Thankyou everyone I rang back spoke to a lovely man he was so helpful he said even though I had evidence a lot of it it didn’t go in to detail about his challenges ect he’s in a mobility pram but said normal for age he’s 5 and he vomits consistantly in sleep and on demand threw out day night ect he’s on path way for autism which has been to panel but waiting for an appointment for diagnosis prob nov and ge has a lot of other issues with they say is normal and every doctor says this is due to sensory and autism xxxx

It’s so wrong & unfair though because it literally asks what your asking to be reconsidered dies it not ?? And if not mistaken it wasn’t the whole claim?!

I had no idea this was the case.
Does it actually say that anywhere on the paperwork?
I didn’t send all the stuff I had previously sent for the NC for the COC because I assumed they already had it 🤦‍♀️

DLA is a whole claim consisting of care and mobility.
Therefore they can and do review the whole claim.

I could probably find it in the legislation and the guides but as I have previously said DLA consists of care and mobility, so therefore the whole claim can be reviewed.
There is no need to provide the evidence for the current claim as they have based the assessment on these details.
Please also remember you are obliged to tell them of any changes to the DLA claim, this includes if your child's needs have become less or more.

Your still on here, it feels like ages ago you received your decision and I’m still waiting 😞 how long did they award your daughter for in the end?

Yes they can. Any department that administers benefits etc; can have random audit checks and internal reviews.

Hey, no nothing yet. I'm so nervous that they are going to take everything away, I didn't fill anything in for the care, I ticked that there were no changes for that

They shouldn’t look at the care side of it if you only ticked mobility, I can’t imagine you sent anything in or filled out the care side of it so it would be unfair for them to make a decision for it. It’s this long wait that’s making you question it 😞 30 weeks is far to long! Did say you was doing hrm under vuw or smi?

I dont think they look at the COC in date order as I sent mine In for my daughter scan date was 17/09/25 award was previously for Autism/ADHD sensory needs at HRC, LRM but submitted COC due to Leukaemia diagnosis in July, did not tick the special rules box as not a terminal diagnosis. I received a letter to say it had been Awarded at the same level as last time on Monday, I rang and spoke to a Lady and asked them to get the decision maker to look at it again as it looks like it had just been Put through as a renewal not a COC, renewal was due Feb 26 and new award letter was Feb 26 till Feb 28. The lady said to ring up next week if I hadnt heard anything but I had a payment of £47.85 go into my bank today, so I rang up this morning and the award has been changed to HRC and HRM. Payment was 1 week difference between LRM & HRM. So it took 4 weeks to do my COC and I have no idea why it was processed so quickly was expecting to have to wait till renewal in Feb before it was sorted.
