MR 21/03. Rang yesterday, a decision was made Sunday and she told me he’s gone from MRC to HRC and we had asked them to look at HRM which they said he doesn’t meet. He’s 5 in January, so hasn’t been able to get low rate yet either, but does anyone know if I can lodge an appeal (as I do feel like he meets the criteria, I’m awaiting the letter with the reasons why) and then also do a COC when he turns 5?

The COC wouldn't get looked at until at least march at this point but you can do a COC and an MR at the same time, it's just whichever would get looked at first and which decision would stand as the second one to be looked at could still override the first one.
I guess see what the reasons are that they declined it?

This was the result of the MR so would be looking at going to a tribunal - does the above still stand for a tribunal / CoC’s?

Ah yes sorry, so tribunal would only look at up until the date your COC came into play if you put one in. What did they say originally was the reason they declined the HRM?

Did you call to see if yours was with a dm in the end? Mines still not been looked at yet.

I haven’t called yet, I actually hate calling them, I normally call on a Friday so I’ll maybe call this week but looks like things are taking longer or right on the 30 weeks so not really expecting anything anytime soon X

Thanks for the info. So I rang yesterday to see if a decision had been made yet and I spoke to a lovely lady who informed me on the change of mid to high care and that he didn’t qualify for mobility. I then rang back later as I wasn’t sure if you needed to request a statement of reasons and the guy said the letter I am waiting on will explain why he didn’t qualify. Interested to see what the reason is this as I followed the SMI flowchart and evidenced each point with statements from medical letters 🤷🏻‍♀️ will have to wait and see!

As a thought did you send them their restraint/positive handling plan from nursery/school? That's something I ve seen people miss out and it being a sticking point with DLA

Yeah the restraint one is the one people 'fail' on as it has to be more than 'mum says' and the use of a buggy and in all settings

That was one of the things I thought may have held him back! He’s just started school in September and only attended nursery 1 day a week prior and didn’t have a plan. Going to ask school for if he has one there. The evidence provided were statements from EP, OT, nursery/ Paediatrician stating

“Adults need to support him to keep him safe. He has previously
required hospital treatment after head-banging caused a cut.”
Occupational Therapy Report, EHCP, Paediatrician Report: He frequently puts objects in his
mouth, climbs to dangerous heights (windowsills, furniture), and has no awareness of
danger, requiring physical intervention daily.
Occupational Therapy Report (Page 3): Observed sitting on windowsills, demonstrating
unsafe behaviour requiring physical removal.”

I think words like ‘support’ and ‘physical intervention’ instead of specifically using the word ‘restraint’ may have gone against us.

Oh our kids must be similar ages. Yes I reckon that's what's done it as although it's in the EHCP their behaviours being "extreme" perhaps the physical intervention part to them wasnt the wording they wanted. My son's Sen school insists on parents signing the restraint plans so I imagine their school will be asking for one if they didn't sort it prior to starting there

I’m only calling once a week now, it puts me off they won’t tell us anything until a decision has been made, like we haven’t waited long enough to be told the truth! I have a feeling they have gone on to May because someone’s claim is already with a dm. It will be interesting to see if they get a decision at 21 weeks like the end of March did. Was you applying for HRM? I wonder if that is what’s taking longer?

I don't understand it all, he already gets LRM, and I sent so much information off, I'm going to send some more, just waiting on his consultant letter coming through from an emergency appointment last week. I'm hoping it's because they are waiting on some information from either the school or his paediatrician, if they could just give us some information when we called, it would stop the constant calling in to them

I put in a NC last week, just received a text saying we aim for a decision within 25 weeks. So I think I'm in for a long wait. Or do they come back sooner. Its all new for me I didn't know we could get it for DD and shes 10 now.

Based on your name - looks like we’re similar age too as I’m also 1995!

I’m going to ask on pick up today, I signed a load of forms when he first started but can’t remember now if the restraint plan was one. He’s in a designated provision within a mainstream school, although I think he needed a full Sen provision to be honest.

It's not too late to say you want a sen school,since they aren't 5 yet their EHCP reviews should be every 6 months so if you aren't due one already you should be soon or ask for an emergency one. It shouldnt be the case at all as we know many children don't get Sen schools when they needed them but they might have looked at their application and gone oh that's mainstream nursery and there's no mention of them starting at specialist school when they were looking at smi too.

Yes I m 30, son's 5 in November :)

Good news here!

A payment ref DWP DLA is showing up as going into our bank account tomorrow, our claim must have been accepted! I haven't received a letter or text and I have no idea whether it's backdated or how much DS has qualified for, whether he got mobility and care or just mobility.

It's really good news I know, and the money will make all the difference. It's still bittersweet though as I'll have to properly accept he has a disability now 🥹

COC 17/3 when i rang 2 weeks ago as our renewal is December. He said it could be another week could be a month but we’re at the later end. Just waiting game.

You would receive back payment tomorrow if you’ve been awarded, you can call on option 4 and they would be able to tell you the decision over the phone.
