DLA Wait Times 2023 (Part 10)

Hi All,

I have been reading previous threads related to this which all seem to be full so apologies if this is wrong (Im new). Applied for DLA for my 18month old son, scan date was 11/04 and had letter saying upto 15 weeks for a decision. Question is, i received a 2nd letter from DWP asking for my sons original birth certificate to be sent in and it would be sent back immediately. Has anybody else had this?

@GG89 I was declined too one of the reasons was mainstream school and not dissimilar to a child of the same age so stupid

Honestly hun horrendous isnt it.
my son also suffers with severe anxiety which i believe to be linked to the asd.
In school he doesnt express himself in anyway his teacher told me, eg if his struggling he wont say that he will just struggle in silence. He will only go to the same 1 familiar adult, his so anxious he wont even ask for his shoe laces to be done up she told me she could see the fear in his face when wanting to ask. How they make these decisions is beyond me. I know several people in person whos children have less support in school then my son with no echp, in a mainstream and still been awarded.

Omg how dare they say because ur childs in mainstream and no ehcp in place means they dont qualify! My son has autism and had no ehcp in primary school and was in mainstream and was awarded a few years ago! Thats so wrong it is not criteria that these are in place to qualify! My son has left his secondary mainstream school now he only lasted half the year so needs to attend a school specialising in autism now and weve applied for ehcp aswel but he didnt have any of that when we applied last time thats disgraceful they have given that as a reason!

Thank you for your reply, this is reassuring. I am going to do a MR and fight for what he deserves. I will even take it to tribunal if needs be. They are saying his needs are no different to a child of his age because he has no echp, his in mainstream and has a small circle of friends. Which may i add are the same friends his had for years (2 friends) and he will not go outside this friendship group.

I know I felt so deflated after this long wait but at the same time I saw online 50-70% of claims are awarded after an MR so it's boosted me to try 😂

Im wondering if they decline so many claims in the hope we wont mr.
i have no clue where to start.

Yes i would 100% go to MR thats absoloutley disgraceful they have given those reasons! So a child with a disability shouldnt have friends! How dare they. Im absolutely disgusted for you. My son is the same if anyone speaks to him outside the home or that he is unfamiliar with he just freezes up in terror. He wont ask questions or for help ever. He stays quiet and shutsdown in most environments like school etc. I cant believe theyv rejected ur claim for those reasons that is disgusting and feels like discrimination to me saying because he has friends, sorry wasnt aware our children with disabilities had to be loners in order to qualify for a benefit for children with disabilities. Im really angry for u lol

I actually took my son out of mainstream school too home school for best part of 3months or so because it was really affecting his emotional well being and his mental health after the transition from year 1 - 2. But i then put him back for the socialising part because outside of school he doesn’t socialise at all. I cannot get him out the house. All my other children are suffering also x

@GG89 sounds the same as my eldest. I try to take the younger 3 to the park and the eldest with have a meltdown about going, makes it impossible.

Literally this!!! I cater to my son so much so that my other 3 children miss out on a lot.
but thats whats normal for a 7 year old apparently 🤣.
i have 2 children in the same school.
1 being my son with autism and my other son being in nursery.
i would have to collect my asd son and take him straight home from school and then i would have to walk back round to collect my son from nursery. Although both in the same school and more convenient for me to collect at same time. If I disrupted his routine he would have a meltdown x

@ThankYouStavros it should say a timescale in the letter giving you your scan date. Mine said 15 weeks and mine was scanned at the end of April. Interesting to see if they are still going by 15 weeks or increased

After reading these declines yesterday I'm so angry for you with the reasoning being awful. And has now made me worry I am in same line for decline too. Even with a letter from paedtricians showing her qb test results saying she is 99%/96%and 91% more impulsive, inattentive and hyperactive than girls her age. The school my daughter is at our awful and I have put in a formal complaint and emailed the department of education about them as they refuse to put my daughter under SEN and give her additional support follow her management plan from paedtricians the SEN teacher even said " we don't have to follow the doctors" and the head teacher told me "I need to control my child" and "get her meds reviewed she might need them put up" she is 8 years old and only been medicated for 3months and they call me regularly and say she is misbehaving but when I said surely that is enough to give her extra support the answer was "no there are other children that need it more than her" so I told them to stop calling me all time then at work and threatening to suspend her if she isn't that much of a problem. This is what made me decide to do the formal complaint against school but now worried they won't support with her DLA. My daughter only misbehaves cuz she struggles with the work too and no one will help her. I'm currently looking into a EHCP but I don't know if I can even get one without the school backing me as I mentioned if I get one will she get help and they might aswell of laughed in my face and said she won't get one . Won't stop me trying though.

The same has been on my mind all night and I really hope all the ladies go for a MR because it's disgusting that the children and refused what they are entitled to!

I have all the doubt in my mind my son is also going to be declined as he is only 2 years old. He has never responded to his name, doesn't say any words or understand any at all, harms himself and others when both excited and frustrated, only eats a handful of beige plain foods, has absent seizures, is still heavily on a milk diet among other things and now his hours have been reduced right down to 2 hour intervals at nursery due to them struggling to meet his needs.

Let's keep our fingers crossed for our little people. Definitely going to call today before the weekend is out and see if I can get some clarity

Sending my support to all the ones declined yesterday! You've got this fight 💪🏼This process is gruelling but your little ones are lucky to have you all willing to go above and beyond.

@Lolli0511 i have the same exact worry as my little one is only 2 aswell I’m ringing at 9 as no phone call at all yesterday my child has put holes in my walls with her head bruises up her arms from biting herself and others and so many development delays so if I get rejected it’s deffo MR as her Pediatrician letter says on his review form that it’s highly likely she has autism with all the struggles she’s going through lately

Aww it's awful watching them go through it and waiting on appointments and referrals isn't it and now we have this on top of it! I have the same on my ped and SLT review forms too, so hopefully this will help our cases. This process definitely wasn't thought out with children and parents in mind.
You called to complain didn't you as you are March? Definitely chase it up if they haven't called you back. I was going to wait until Monday to put in a complaint but I'm hoping if I raise it now it may be done over the weekend

@Lolli0511 it really is, we don’t need the added stress either 🙁! I’m 3rd April I only complained as they changed my decision date 3 times! What date are you on? So many people on here I get confused haha! Will keep update see what they say and hopefully will get a decision by Monday! .. it seems the people who complain are getting their forms sent to the DM so it could be worth a ring

Said a note has been sent to a team leader yesterday and can not guarantee when they will even ring me it’s not even been looked at yet and can not say when it will be either so still no further forward

What a nightmare!
I've just had a lovely man that has gone above and beyond for me, he even put me on hold to try and find a manager now for me to speak to but they were on a call so they said I should receive a call in the next 3 hours but said he will keep and eye on my claim and if a decision comes through today he will give me a call as well as request a text back. But he did state it should be today or this weekend and I'm the 5th April so hopefully yours also comes through

@Samiieyy thank you for this. I'm going to send off my MR today man on the phone said once received they're taking about 3-4 weeks so I guess not too bad.

The reasons are insane she had support for reading, writing and maths she's behind at school but not on a plan. Telling me it's age appropriate but this is due to her ticcing when they're bad she can't hold a pen or read if her heads jerking or eyes rolling for tics to me how is that the same as a child who is the same age they don't have uncontrollable tics.

There's more reasons I'm challenging aswell but it's honestly so stressful

This is soul destroying reading all these declines over things absolutely ridiculous!! They're failing our kids the system is messed up, especially when I know people abusing and swindling the system with barely any disabilities/additional needs at all .. it needs to change, I really wish they could live a day in our lives and see the struggles we have as parents with a child that has additional needs on a daily basis.. it's exhausting!!
I've rang up today to actually complain as I'm 16+1 but I didn't because they told me my claim is FINALLY with a case manager and I will receive a text with an outcome over next 7 days. I did ask if the case manager was also a DM and they clarified with me that they are 2 of the same they both make decisions just a case manager is lower banding..(CM & DM always confused me)... keeping everything crossed for a good outcome.

I hope everyone declined 100% fights for a MR and your child gets the support they clearly deserve!!! I know I will be if mine is declined.

There is no consistency with the training given and I think some of the call handlers just fob you off to get you off the phone. Hopefully the team leader will be chasing up calls today and you are one of the first! Good luck and let me know how you get on, hoping to hear good news from you before the weekends out
