My husband says (during an argument) that we aren't really married because we didn't consummate our marriage by having sex!! Therefore if he divorces me the judge will do it straight away without even talking to me or considering my side of things because he will tell the judge we didn't have sex that night!! Apparently we are not legally married??

I'm sorry that you're having to go through this. This has been one of the most satisfying threads ever on here though. Time after time I read ones where people are being dragged through years of solicitors/court etc, how good to be able to get this idiot out of your life so quickly! There are good, kind men out there. You deserve so much better. A holiday sounds like a great idea, something to look forward to for you and the children.

I have a law degree and am an LPC graduate (not a lawyer yet, but I have studied this) - technically speaking a marriage could be annulled because it has not been consummated. Marriages have been annulled even if there is a disability preventing them from having sex. So unfortunately he could apply for an annulment.

However, if he's going to ask for an annulment on these grounds given you've just had a baby and have got stitches, frankly you're well rid. He's a twat.

Hi all thanks for your support, just an update, my solicitor is working fast for me which is very nice and comforting, court: is next bloody Friday!! My solicitors friend/colleague has told her due to my evidence and explanation of unwillingness to engage in sexual intercourse with my "husband" (vaginal discomfort) that I would be 100% guaranteed an annulment!! Boom solicitor can't wait for court, think she's more excited than me lol!! Iv not told him but solicitor has sent a letter that should get to him at the address I provided by the end of the week. If he doesn't show or pretends he ain't got the letter it will be granted in his absence. They may want to see my medical records to prove my foo foo is a mess lol but I'm cool with that!! Iv contacted my doctor already and he said he will send any correspondence I need him to.. Just waiting for solicitor to let me know if they need it. Iv had an emotional morning and felt quite sorry for myself bla bla!! So o decided to spring clean, me and the kids had the music up dancing and I was secretly packing boxes of his stuff I had left, Iv packed him plenty of photo albums of our wedding day so he can enjoy them also Iv packed him his debt letters that I was going to pay but not now I'm afraid and Iv also packed a packet of condoms for my own enjoyment lol.. Juvenile I know but Iv put a little ribbon around it.. Ha!! Iv also paid TV license with the joint bank money so thinking he may has £1 due to him next week, not even a enough for a packet of condoms hents why I bought him some lol. I figured he will now have to seek benefits to survive now he can't have my earnings, so I spoke to Csa and they said to let them know, I may get 7 pound a week for them but it's still money I can put towards the balance I filter into my children's accounts each month for their future, why shouldn't he contribute to his children's future!! I do.. It's about time he takes some responsibility!! Dumb ass.. What was I ever thinking!! He spitefully text me saying he's had a good fuck last night so if for any reason annulment doesn't work and we take the divorce route.. I'm sure I can look at adultery lol I don't care.. The court will see him for what he really is and support me. Thanks for all your support guys.. I couldn't have done it this way without knowledge and support so thank you. Oh also Iv cancelled his gym membership, his phone contract and his trip to watch the footy.. He may have a shock when he attempts to use these things and can't lol.. I'm not paying for it and suddenly I feel richer xx

OP get a doctors letter anyway just specifically stating that you're unable to have sex due to having given birth with dates showing clearly you couldn't during your marriage.

I'd have the letter to hand just in case, as you don't want an adjournment to get more proof.

Better to be over prepared.
