Can I just clear something up? I think the term "age of consent" adds confusion to this issue. And I apologise if I am blunt in my language. It's just for clarity. LEM and others in a similar position, I apologise if this is hard to read, but for other little girls like you were, it's important that people know this.
The law, as it stands, states that under 13s cannot give consent, legally. So, however willing the victim, rape or sexual assault charges can be brought, depending on the gender of the perpetrator and the acts that were carried out. The sentences are in line with each other, whatever the charge.
Between 13 and 16, if both are of a similar age, the official guidance is that there is no public interest in prosecution. Providing it was consensual. Rape is rape (and sexual assault is sexual assault) , whatever the age. However, if the elder is in a position of authority or is over the age of consent, then charges may be brought. Those charges depend on the nature of the act.
As we know, the reality of bringing a case, or even reporting it, is too difficult at the moment. But that's the law as it stands.
