So FTB,
Latest update last week was solicitor waiting for an enquiry raised with sellers solicitor & 1 search to come back.
Almost there!!

Anyone else with me?

Well I've just had a chat with my solicitor. The document missing at the top of the chain, is, believe it or not, the contract of sale, so nothing important then! Shock

Apparently the probate sale is being managed by a bank on behalf of the deceased person's family, and they've massively cocked up by not signing the contract.

Our solicitor is reasonably hopeful (because every solicitor in the chain is complaining very loudly to the solicitor at the solicitor at the top about how on earth this has happened) that this contract will appear in the next working day or two. So, he's going to request funds from our mortgage company today to work towards completion on the 29th still, but it's a risk (as we'll be liable for costs if the money is sent down and then we have to return it if we don't exchange) so if we don't exchange by early next week at the latest our solicitor will try and cancel the transaction mid-way through before we get charged.

The cherry on top of all this is that we still can't organise any removals as we still don't know if we're moving next week or not. Also DH's work is (understandably) wanting to know if he is booking time off next week or not and getting a bit huffy about the whole situation.

Kitkat that is shocking!

I'm think that moving house is like child birth, very painful at the time but somehow we must forget how painful it is because we willingly move again.

That did make me laugh Sandy! Although right now I think moving is worse than childbirth Wink

This afternoon was an emotional rollercoaster again. Got an email from my solicitor saying everyone was ready and he had been told to call solicitor above back to exchange. Great. I started fizzing with excitement and checking emails for The One saying it was done. Finally got one two hours later however I was only copied in and it was my solicitor (to the one above) saying he had tried calling four times and to basically call him back. That was at 4.15 and nothing since so assume everyone had buggered off for the day. (If they can even transfer funds/deposit that late???) So I went from super high to feeling totally flat Sad I hate other people's solicitors!!! Why can't they just get their act together?!?!?!

Should now be tomorrow surely...

Another day without exchange. Getting really fed up here too.
It all feels so out of our control which I think is half the reason it's so stressful!
As far as we know we are only waiting on our buyer's revised mortgage offer which really shouldn't be taking this long as it's 2k less than their original one Hmm

Completely agree MrsBrightside about the emotional rollercoaster thing. I was told last Friday that we would exchange on Monday, and subsequently every day this week I've been told that we are exchanging today, and every day this week something has cropped up which has prevented exchange from happening. So have literally woken up every morning thinking 'great we should be exchanging today' to end up flat and disappointed by the end of the day. Fingers crossed we both exchange today!

That's mad HelenTheHunter . Surely the bank can just approve a mortgage of 2k less than an original offer without scrutinising it from the beginning again?

I'm also very twitchy MrsBrightside. Estate agent e-mail at 11am basically said he's chasing the missing contract so we can try and exchange today. However it's really cutting it fine now. By my reckoning the contract needs to be signed and returned by mid-afternoon (so 3-3.30ish?) at the absolute latest or we haven't really got time to exchange today, and we may have to cancel our requested mortgage monies.

Pretty much just staring at my phone and e-mail desperately willing it to ring with news now.

Email from my estate agent to say everyone is chasing and we are just waiting "for the solicitors to do their thing." Wish whatever that is they would do it a bit f**king quicker!!!!

Took your advice KitKat and chased up yesterday - had a chunk of answered enquires sent over to me to see but between the seller & their solicitor they have given really vague answers on the rest so my solicitor now has to go back again.

She is requesting a few indemnity policies too to cover off things that are missing.....are these likely to involve lots of negotiation do you think?

Urgh it just drags doesn't it...

Had an e-mail from estate agent and a call from my solicitor. No news about the missing contract and no clarification yet from end solicitor on when this is arriving (!)

My solicitor will try and contact the end-solicitor AGAIN and try and let me know at the end of the day if exchange is at least likely to happen on Monday. If not I guess we're going to have to try and agree a 3rd completion date.

This whole week has been an absolute farce.

TeaMeBasil the indemnities are possibly likely to involve a bit of negotiation yes. The other side may dispute whether these are really necessary. Hopefully it can be resolved for you quickly.

Should have exchanged yesterday. Still nothing. The house builders want us in by next Thursday. Very stressful. Good luck everyone. And congrats to all who have exchanged

I can Home to a load of posted paperwork including land reg docs, inventory etc.

Still says waiting for sellers solicitors answer to enquiries, once received them I go in to sign documentation.
I assume this in contracts etc?

Mynxie - What? How on earth has that happened? Isn't a completion date normally agreed when you exchange?

Thank you TeaMeBasil. I was actually quite upset earlier (not helped by poorly DD2 crying in my face most of the day) but I'm trying to remind myself there are worse things in the world and we will get there eventually. But yes, a big glass of Wine later methinks.
