Thought I'd take the liberty of starting us a nice new thread as the other is getting rather full. :)

if you claim (i think JSA) and you find a temp job, when that contract is over and you are unemployed again. do you have to wait a certain time to claim again or can you claim straight away?

SAF - not me me me - I am in that position, although it is being held off for a few years until DS3 is school age. If I hadn't had DS3 - I'd be there right NOW, as DS2 is 8yo, I would have been changed over (and refused JSA) when he turned 7yo. I was apparently the first person in the COUNTRY to bring up that issue to the DWP, way back in June 2010...Was frothing even then, before it had a name. The DWP, even top managers that rung me to discuss it, had no answer for the ESA/JSA trap. And still don't.

If you get your DLA renewal first, it would be odd to be refused ESA - but I have heard stranger things...It would give you good reason to appeal the ESA decision though.

Blackout, my husband was in this position quite often, you can re-claim straight away BUT they still take ages to renew your claim.

I have a new logo (clearer and has too many cuts as its headline and #frothers underneath) to upload, but i dont think i have the rights to make those changes as am an author (or am i being slightly dim?). Can I be added Mme or Garlic?

Yes, they look at any pay that should be owed to you (even if you don't have a snowball's chance in hell of getting it actually PAID to you) and decide how many weeks that (theoretical, often) pay is meant to last you, and they tell you WHEN you can claim.

And even when you DO claim - the first 4 weeks are not paid. Supposedly the new UC is going to sort out that loophole - but I'll believe it when I see it!

I had this when my last employer did a moonlight flit because he couldn't afford the rent increase. I was owed 3 weeks holiday pay, plus redundancy money. JSA took that into consideration, and told me that I couldn't even CLAIM for 8 weeks - and then I had to go another 4 weeks without money. Angry. So 12 weeks with no JSA.

And at the same time - HMRC fucked up my TC's TOTALLY and didn't pay me for 26 WEEKS. It took my local MP getting involved to sort that one out - .

So, for 12 weeks, the only income I had was my child benefit for my 3 dc. Then for another 14 weeks, all I had was my Child Benefit and £55 a week - it was £10 less a week because I had had two crisis loans while I wasn't getting JSA or TC's.

They are a shower of inept arses at the DWP and the HMRC IMO.

so if you were on jsa and had the chance to work on a temp contract then it really wouldn't be worth the hassle to get back on jsa iykwim

blackout - it might be worth it if it is likely that the employer will keep some of the Temp staff on after the temp contract ends. If not, it can cause more hassle than it is worth - because you have to factor in delays with processing change of circumstances for Housing Benefit and Council Tax benefit, where you might have to cover the costs of your full rent while you are waiting for backpay, so that you don't get a Notice of seeking Possession.

swallowedafly - I'm totally with you. I'm really concerned atm as well. Waiting for a medical for ESA, seems they will deem me fit for work as won't qualify for the point system as have fluctuating condition, and terrified then this will cause me to lose DLA (have indefinite award, but we all know this means nothing as DLA is being replaced by PiP which is far, far narrower) - so will end up worse off. I just don't understand how this can be allowed to happen, where people will be stuck, literally, without nothing.

I am, literally, frothing.

I am so grateful to you all for what you are doing. I'm doing my best to join in but rather pathetically given not being able to breathe too well today. It is so good to find a place where we can talk about this stuff with people who understand and don't think you're scum. I've been so fed up with all those saw-my-neighbour-walking-to-the-shop-so-shall-I-report-her type threads (Peachy you know what I mean, we always end up on there, always saying the same and there's so much ignorance out there) - but it's so good to have this safe place.

thanks HuntyCat just setting my sil straight, she was moaing about all these so called unemployed people and she has got a few temp jobs to fill (a whole month contract with no chance of being kept on)

A month? NAH, no way anyone I know on JSA would take that on - it'd have to be at least 12 weeks to be anything approaching worthwhile. WITH a high chance of a perm job at the end of it. It takes longer than 4 weeks for them to update your HB here - 6 weeks is standard, so there would be two change of circumstances pending, which crashes your claim on the computer in my LA, so no-one would do it.

I'm afraid if your SIL wants these places filled, she's going to have to do better than a 4-week temp contract - in fact IMO her only hope is using Agency Workers. Who she will have to pay a BOMB for, even though they don't GET all of it.

When DH was on JSA we dithered a bit over a 3mth contract and managed to get it extended to 6mths which seemed worth the risk. The fuckers threatened to fire him after 3mths (still in his probation period) for a load of totally spurious reasons - literally, he went to ask what he could do better and was met by blank faces or contradictory advice.

Luckily he is well educated and fit and we could up and move hours away when he found a permanent job instead. A lot of people aren't in that position.
