Change of circumstances dla wait time 2022

Hi I am a single mother of a 9 year old boy with JIA , I put in a change of circumstances to dla as he gets low care but this was awarded for his mental health before his diagnosis and change in care needs . I have been told my application must sit in queue for 17 weeks before it’s looked at . I have been doing some research online about this wait time and seem to find nothing . Would love some advise on other people currently waiting on a coc .

I called yesterday. It’s really bad at the moment. I’m just waiting now. I may call back next week.

My son has cerebral palsy, visual impairment, epilepsy, global developmental delay, microcephaly and many more things. Yet I have to fight for the hrm. It’s shocking really. He has no sense of danger. Falls over all the time because of his visual impairment. Also when walking outside I have to be his eyes for him. He is now 5ft 9. A big boy for just 14. I have had to get a wheelchair for him now as his epilepsy is not controlled and when he gets startled has a seizure. He is also noise sensitive. Which does help when walking outside either. They know all this and still when I re done his forms for dla only awarded him the lower rate mobility.

That’s absolutely awful! Did they give LRM on the last renewal or is this from the CoC?

Im waiting from the end of Dec. My son is on MRC no mobility. I waited until he was near 5 to apply for mobility and I’m hoping he’ll be upped to HRC as his night time needs are… well let’s just say I’m currently sat looking up the best way to redecorate a wall as he spends all night tearing off wallpaper and ripping the insides of his bedsheets, amongst endless other things.

This is from when I redone his dla forms. He gets the hrc as he is unable to do anything for himself but they only awarded him Lrm. I never really questioned it and just got on with it but now he’s so so tall and his epilepsy isn’t controlled anymore. He’s never not going to be disabled. His disability is for life. My son is 14 with the mental age of a 5-6 year old. Probably less and more in some things but cognitively he’s probably at around 5 years old. He still loves in the night garden and my tumble etc so it gives you an idea of what age range. But he is such an amazing boy. So caring and only knows how to love. He does have his moments though as his hormones have kicked in. I always say imagine a 5 year old with teenage hormones and you get an idea again of what he’s going through at the moment. On what basis do they make their decisions on? I see people receive higher rates when they don’t need it and then our children get left short. It’s disgusting. They need to come and visit these children and see the daily complications they go through and then make a decision based on that. Not just tick boxes on a piece of paper.

id finally had enough last year and decided to do a change in circumstances for him and I’ve been waiting nearly half a year for them to make a decision. I’ve had enough. And to top it off when you ring your on hold for about an hour.

Called this morning. Send my child application for change of circumstance before Christmas still got told today fews more weeks . That’s so bad .

@Beckyc87x it’s so difficult isn’t it, for the kids and for us. Our kids are wonderful, but I don’t think people appreciate the toll it takes, especially having to write out all these forms full of such negativity, only to be left waiting for months on end. Then fighting more because they don’t fully understand the information they’ve been given. Best of luck, I hope they recognise the level of needs your son has.

Thankyou, I plan to fight for it this time. I’m sick of my son not getting what he needs. I just don’t understand what takes them so long. It’s horrendous.

That’s the same as me. I sent my sons in and they received it the 22nd December. Still waiting for it to go to the decision maker. Just a question? If you have to appeal it do you know how long the appeal process takes? I just don’t want to be waiting another 6 months again for them to make a decision, if I have to appeal it.

@Beckyc87x so the first step would be a Mandatory Reconsideration. That can take about a month I think, and it helps if you can send additional information. However, they will look at the whole claim again, it does risk the entire entitlement just like a CoC. If it’s still declined, then you can put it to tribunal. However that can take months, longer than a CoC. DLA do review the decision in the meantime, and could decide in your favour before it reaches tribunal date.

@Beckyc87x someone on the DLA Facebook group just said they’ve been awarded their CoC, dated the 12th of Dec. So here’s hoping it will be within the next couple of weeks.

I rang this morning, my son may be getting his ASD diagnosis early next week and wanted to see if I had time to send paperwork if he is. Mine is not with the DM yet but I did see someone was awarded from the 19th of Dec today. So probably won’t get anymore evidence in unless I need to do an MR now but at least they said 26 weeks this time not 28+.

Oh I hope so. It’s such a long drawn out process. I just hope I don’t have to do anything else as I’ve sent in what I can. They can ring my sons doctors etc if they want to to get the information they want. People are actually disgusted when I say he doesn’t receive the hrm as he clearly needs it. Fingers crossed it’s not a long wait.

When I asked for a MR for my son, they spoke with his school and then changed his award to HRM
same as you people were always so shocked when I told them we didn’t get it. My son has autism with learning and developmental delays and obviously as he’s getting older things become much trickier for us getting out and about.
we waited ages I applied in July 2022 and it finally all for sorted inc MR late March 2023. The MR took 3 weeks the rest of the time was waiting for the decision 🙈.

I didn’t even realise I was still on this thread!

I think sometimes they don’t look at them properly. As I’ve seen people that don’t need it get hrm. And then we have children that are clearly should be getting it. Well I’m just hoping that he gets it. I’m going to appeal anyway and tell them to come out and see my son and then make a decision based on that. They will clearly see that they’ve made the wrong decision. It’s horrible isn’t it the waiting time. I’m glad you were awarded the higher rate for your child.

They’re working up to the 22nd of dec right now, though I haven’t heard anything yet. I’m calling Tuesday morning if I haven’t heard anything as a decision should have been made by then.
