Re the change to contribution based ESA/New style ESA to a time limited benefit. I don't think that is currently in the scope of the bill as that proposal is currently being consulted on. This is what it says in the briefing document for the bill:

I I don't think it is? This is the ESA section, which only relates to ESA IR. There is no mention in the bill of replacing cont based ESA with the new unemployment insurance benefit

This is from John McDonnell, who former shadow chancellor who is currently suspended from Labour, on Stephen Timms’ response to the question he and Barry Gardner both asked. (See 7.03pm.)

The government concession on setting up the review of PIP conditions has been rendered meaningless by its refusal to guarantee to put the review recommendations in primary legislation. This means they cannot be amended by votes in Parliament. Further undermines trust.

Unfortunately it is highly unlikely that any such case would win. There is already significant amounts of legislation which have "age related criteria" and courts have consistently supported the view that such discrimination in legislation is proportionate. Housing allowance for people under 35; statutory pension not paid until you reach a specific age even though you have "paid all your years"; PIP not claimable by people once they reach pension age (but many pensioners don't need "attendance" and do need mobility) - there are many examples.
