This really is a mess, isn't it? The bill is simply not fit for purpose.

The thing that gets me is that it really could do with some king of proper reform and these arbitrary changes just kind of get in the way of that happening as much as anything.

@cloudytime I get this for folk still on DLA but for young people they can’t transfer to PIP until 16. They can’t choose to transfer before the changes take effect. Even if they transfer before this date they can be reviewed within a year. Will the 4 point rule apply then or will they be existing claimants?

It is also inconceivable that the new 4 point rule for new claimants will be overturned by Timm’s review of PIP and therefore apply to existing claimants.

It’s all about cuts and obfuscation.

I know children can’t transfer to PIP until 16. My post was about new claimants moving across before the change takes effect not being classed as new claimants at renewal.

Teens moving from DLA to PIP are new claimants when they transfer. But they aren’t new claimants when their award is renewed (with the exception of a small percentage with short awards awarded via Tribunal - which applies equally to rising 16s and older adults) . So rising 16s moving across before the change takes effect will not be subject to the 4 point rule.

The DWP also said that those transferring from DLA to PIP (ie all those aged 16) would be treated as new claimants. What’s the betting that transfer will take so long that new criteria of assessment apply. It wasn’t a fast process before.

Yes, they will be new claimants when they transfer from DLA but not on renewal.

Awards are made from the date someone applies, not the date a decision is made, so surely it will go on the date a claim begins rather than the date a decision is made.

DD is currently moving to PIP. I sent the form in May and I had a letter saying they had all the info they needed.
I’ve seen some people get a letter a week later and some months.
It absolutely should be 18 to move. I had to fill it all in for DD, no way would a 16 ever be filling that in effectively.

Maybe this was deliberate knowing that PIP and UC would create so much fuss they could quietly pass the ESA / JSA thing while nobody noticed. I hope not.

@PhilippaGeorgiou so this basically means pip won't exist in a few years time....
it's all so scary. I think whatever happens at the vote Labour will somehow manage to change pip beyond recognition eventually. Linking LCWRA with pip means there will be no benefit for disabled people

I think it would be very difficult to apply new rules to existing claimants and take their cont based ESA away. I think they said the rules would apply to new claims only.

Andy Burnham has called on Labour MPs to vote down the government’s welfare reforms as Sir Keir Starmer attempts to stave off a backbench rebellion.

The Mayor of Greater Manchester said the prime minister said the changes to the welfare system will create "unfairness and divide" amongst disabled people.

He also said the prime minister had only performed a “half U-turn” which did not go far enough.

Mr Burnham’s comments will be seen as a direct challenge to the PM and an indication of his possible future leadership ambitions.
