What happens if they closes my account?

it is recommended you close your account before you send the first letter asking for your charges back, you can still proceed even though you will no longer be a customer, just open another bank account .

Mumpbump · 19/03/2007 10:58

They certainly suggest opening another bank account before you try to reclaim your charges. Dh got offered about £940 for his claim which was in the regaion of £1600 by the time you took into account interest over the 6 year period. I am only claiming £60 back and they don't seem to be taking it very seriously so I am going to go into a branch and speak to someone face to face...

so if i closes this account and open a new one...cani go back to the old account once its all over?

Haven't read the links, but DH was talking about this last night and saying that it's unlikely your bank will try to force you to take legal action as many judges are no longer accepting the cases.

It used to be that you claimed with the bank and then they tried to frighten you off by saying you had to make a County Court claim for the money. Then they'd let it go to a hearing, hoping you'd back down, but back out on the day if you didn't. The judges apparently got completely fed up with this as it messed about their case loads, so they've apparently taken to refusing the cases about bank charges as they know and the banks know, they can't win and they know and the bank know that they won't let hte case go ot court as it will "open the floodgates" as it were.

Biglips, my understanding is that some banks have closed accounts as a result of a refund. The recommendation on moneysavingexpert is to open another account should this happen. Check out the threads on that website and there's lots of peoples experiences on their.

Banks keep details of transactions for the last 6 years, and you are entitled to see these. I've got as far as requested the refunds (with interest) from Barclays and 1st Direct, but am waiting to hear from them.

i will...ill have a read of it as not read it yet...must go and get some copies of statements of 2003 - 05

will the bank give me my duplicate statements there and then or will it take a few days and post them to me?

Does anyone know if it is definately just 6 years as i have statements for 7 and would like to claim them all ?

foxybrown · 19/03/2007 12:24

takes a few days/weeks to send them to you.

i think they are obliged to keep records for 6 years, but haven't seen anything to say you can only claim 6 years worth. I'd claim the lot, they'll soon tell you if they aren't going to give you 7 years worth.

I have received money back from both of my banks!
The co-oporative & The Nat West.
Got £400 from co-op & over £1000 from Nat west.
Sent them both a good snotty letter & didn't close any accounts with either of them.
Co-op didnt send me any bank statements at all & put the money in my account before I even received the letter about it.
Nat West was a little different, they sent me my last 6 yrs of statements tehn I had to outline where I thought they had charged me & been unreasonable, THEN send another letter.
I posted the original letters at the end of Jan & received both monies within a month or so.

Good Luck all who is trying to get their money back. Go Girls!

Any success stories with Lloyds TSB, such as musiclover's?

We're in the middle of moving all our debts away from LTSB so that they have no "hold" over us when we ask for the charges back.

A conservative estimate is that they owe us about £3K. Our joint acct often went over o/d limit when we had money in all of our three other accounts. Happened when we forgot to transfer money in to cover the shared bill etc, so on that basis we'll be saying they had more of our money than they had of ours, therefore the charge was unfair.

twelveyeargap · 19/03/2007 16:54

£5 in total or £5 each??? Asking becuase I know Amex charge some astronomical sum per repeat statement for the corp cards here...

Biglips · 19/03/2007 16:56

£5.00 total

by LAW the bank can only charge you £10 max - its under the Data Protection Act 1988

Phew!

Mumpbump · 19/03/2007 17:25

There was a documentary on this a couple of weeks ago and LloydsTSB went on record saying that if people really had a problem with the charges, they refunded them. Which I think is pretty good, actually.
