Mellowma, I read you are waiting for you refund from the Halifax. I've been waiting for mines from them for three weeks now, (Bank of Scotland but the same people). I have just been on the phone to them and they are not being able to meet their 14 working day deadline for some repayments.
Just a warning that it might take a bit longer at the moment and you may need to chase them.

Lolly68 · 16/04/2007 13:54

I wrote to Natwest at end of Feb and have just heard back from them saying that they will be sending me bank statements shortly. They also said that they will pay out only as a "goodwill gesture" and still think that there charges are fair. Has anyone else claimed back from Natwest and do they close your account once they pay out???!!

EB1 · 16/04/2007 14:42

Crikey! I can't believe how many of you have had payouts. I was going to use one of those firms that do it all for you, are they any good?

Mellowma, I think your fab, I've learnt so much reading this thread I am tempted to have a go at claiming myself now, I thought it would be really difficult with the legal jargon they use.

I'm with abbey are they difficult to deal with?

Well done to everyone who's succeeded.

Mumpbump · 16/04/2007 14:43

Dh's ex just got a fairly substantial refund from the Abbey National. They got as far as entering a Defence though!

casbie · 16/04/2007 15:06

excellent! i've had £90 worth of charges refunded from one month from abbey. took one letter and 4 weeks.

my issue was that the charges were 'unreasonable' for £12 in total over my overdraft!!

if you know that the charges were disproportionate to the actual cost, then i would say you've got a very good cause.

we have been scammed for so long - go for it!

quadrophenia · 17/04/2007 15:15

well we have had no response to our LBA and times up so we have filed our claim today eek

Lolly68 · 17/04/2007 16:27

Hiya Quad!! Good luck with the claim. I'm still waiting for the bank statements to come - it is taking ages!

flutterbee · 18/04/2007 13:25

Hi I would love some help.

I have just had a look over my Natwest statements for the past 6 years (only needed a phone call to get them) and I have added up £766 of chrges for being over drawn, bounced cheques etc etc I just wanted to check a few things before I ask for anything back.

a) Shoould I minus £12 off every charge because of that being the reasonable amount or shall I claim for the lot?

b) I notice you say claim Over draft interest which I haven't added up yet but I think would be worth doing, but, I am still in my over draft today and I'm scared it will have an effect on my account! What do you suggest? I have stayed inside my O/D for most of the time I have had it can I still ask for the interest back on this agreed O/D or just when I have gone over my O/D limit?

Hope that makes sense?

Mumpbump · 18/04/2007 16:16

Claim the whole amount. I am not sure if you can claim overdraft interest since I would think they can legitimately charge that, but you can claim interest on the amount which you claim. There is a website that will calculate the interest for you, but can't remember which one it is now.

Mumpbump · 18/04/2007 16:17

Sorry - claim the total amount initially, but be prepared to discount your claim to get settlement. There was a documentary a while ago which said that the average cost to the banks across the industry for setting up an overdraft was £4.

Been meaning to post this for weeks. My friend (non Mner but found out about this through me) claimed £2,800 from Lloyds TSB and they offered her £800 in "goodwill" which she refused and went down the route of the small claims court for the full amount, acrueing a couple of hundred pounds worth of charges along the way.

Last month she was successfully refunded the full amount plus court charges (amounting to over £3,000!)

I personally accepted a goodwill offer (£300 for £700 of charges)which was a better deal than the one my friend was offered and felt nervous about her going down this whole small claims route.. but turns out her instincts were right.. banks don't actually have a LEGAL leg to stand on regardless of all the waffle about "goodwill" and stuff.

Just thought I'd post that to spur people on with their claims!

PinkChick · 24/04/2007 12:27

sorry cant read full thread, but if anyone got letter back after stating how much the bank owed them saying they would be getting nothing(meaning you had to pursue the court route) how long was it till court date/payment came thorugh?

katylou25 · 24/04/2007 13:16

Have just had statements through from one of our accounts - added up charges and there's £1000 there so will be writing claim letter tomorrow!

FoghornLeghorn · 25/04/2007 07:49

Just to let you all know - we received £1186 into DH's account yesterday. It took 12 days for the money to go into account but it was only that quick because DH called and complained, NatWest said they were 3 weeks behind with issuing refunds because they had so many people doing this.

becksmummy · 30/04/2007 11:36

Hi I have just seen this thread and its brilliant, I want to start the process of claiming back my charges from a couple of years ago from the halifax.

I havent read all the posts but it looks like I have to start by requesting copies of all my statements?

Does anyone know where I send this request and anyone been successful with the Halifax??

Trix11 · 30/04/2007 12:52

Hi Mellowma

I have not heard back from the abbey and I sent my letter to them recorded delivery on the 10th April, I realised a week later I had probably sent it to the wrong address to resent it recorded and still I have had no response.

The next stage for me now is to file a claim. Aaarrghh what exactly do I do now?

Thanks for your advise.

becksmummy · 30/04/2007 20:05
