lotus I sent them a letter from my parents and his when they asked for the original evidence, stating that we are separated and the reasons why I still rent from him but they just ignored them. Is that the kind of thing you mean?

Admiral, yes, although of course friends and relatives might be lying in court actions all the time we have letters or signed statements from people who if necessary go int the witness box to say what is the truth and then the judge decides who is lying and who not. People's word for something might not win out over loads of film footage proving a man lives there but it is still evidence.

Thanks for the info Lotus,yes friends and neighbours can be accused of lying either way ie in your favour or not! No one knows my business where I live I don't speak to neighbours where I live but that's neither here nor there,if they decide not to believe you then even if they walked in at 3 in the morning they won't change their minds! I'm slowly losing the will to live I feel like I'm backed into a corner desperate doesn't come close

Lynn I got my letter direct from hrmc, it took them seven weeks to reply but they made their decision before the 26th march,stopped my money on that date and I got a letter from them two weeks later. I'm sure someone will tell you how long it takes coming from concentrix

The thing is he does still live here. Because its his house and I can't afford to leave. I'd need almost £2000 to start renting privately around here, and the council wouldnt consider us because we have separate rooms and theres no domestic violence etc. I tolerate him for DDS sake, but they only need to ask anyone I know to find out how much I hate the stupid cunt!!!!
HMRC knew this though. THEY are the ones that told me to make a single claim in the first place !!!!!
I know the desperate feeling Morgan... Dr has upped my dose of antidepressants but I now have the choice between the medication or milk for dd for the next week, because sadly, I've not got enough for both, and needless to say DDS needs come before my own.

Isn't it disgusting Admiral that we have to choose because we can't afford both. I've got a Wicklow on my finger which has now spread all around it,no point going docs cos i can't afford the antibiotics so I'm sitting here a finger doubled in size and not only stressed up to the eyeballs but in pain too. All I've one is told the truth but it seems even telling the truth isn't enough!

It is all very slow too and that has always been so with HMRC. It is not at all rare for tax investigations to take 2 years because often they will not reply to a letter for 4 months even if you reply the next day to all of theirs.

In theory yes it should continue KittyKat, what ever happened to innocent til proven guilty? They stopped my claim and I didn't know until I checked my bank,it was a further two weeks later I actually received a letter telling me this had happened. Disgraceful, breaks my heart my dd has to go without even the smallest treat for her birthday, let alone anything else. SHAME ON THEM!!

Morgan when you got your letter off them did they tell you then they wanted to pay back the 7000.?. It's about high time they realise it's the kids get the brunt of all this, talk about fighting child poverty?! Makes me laugh.

kitty the letter I received asking for the £6000 back didnt have a date on it or a payment slip, but their website says that they will not chase for payments while a reconsideration/appeal is in process.

I had an overpayment of £65 last year because of the change of claim (not sure how because I was entitled to more when we split)... I was told about it in april and didnt receive the ban giro to pay it until november!!!

Also, if any of you are on facebook,I was recommended to join a group called beat the banks and bailiffs.You have to wait for them to approve you, but I asked if anyone had successfully appealed a decision to stop payments and there was quite a lot of positive feedback. One lady said that her case went to court and HMRC ended up having to pay her all of the payments she had missed since theyd stopped her claim

Sounds like they ain't got a clue admiral, I do hope you, Morgan and all the others get it sorted ASAP , like I said before it's the poor kids that are suffering big time!

Thanks KittyKat yes it's the kids suffering really makes me angry,I feel so helpless I've done everything I can but still no reply from anything. Disgusting behaviour from them it's rude and ignorant,they make their demands we comply yet nothing in return. I've emailed Louise Boyle and Ian Duncan Smith but guess what no reply from them either,looks like we're on our own in this unless some kind soul who has a bit of clout decides to read this thread.

KittyKat no they didn't tell me when I had to pay it back just that I had been overpaid,I can't even live properly let alone pay anyone back.

In fact HMRC almost had the rules changed (not specifically to tax credits) about a year ago to much uproar from many so they can take people's money from their bank accounts before a final HMRC decision or court hearing about whether the tax payer or HMRC is in the right. It's appalling in my view. It also means those people with big disputes will not have the money to pay lawyers to defend them as HMRC will have taken it.

I see from an article in November it was watered down a bit

"George Osborne has watered down plans to dip into taxpayers’ bank accounts to seize unpaid tax debts in the wake of a backlash from MPs, banks and charities. Taxpayers will be given the right to appeal through the courts before outstanding debts are removed from their accounts, as part of a number of safeguards aimed at defusing criticism of the reform."

Lotus,does this mean they can take our money from our accounts without our permission,if any of us have any money in our accounts should we be taking our money out? I get paid weekly and will be taking the lot out every time I get paid if this is the case or better still ask someone else if I can have my wages and child benefit paid into their account. This is never ending.

That's just what I'm thinking Morgan I've cut right back to hold on to money incase the inevitable happens next week n I've got no money going in..... So shall I take it all out? N what about direct debits do I have to cancel them all? God! What next?!!

Oooooh I don't know KittyKat I'm going to have a word with my bank n see if they allow tax credits to take my money without my consent in the meantime I have nothing in there cept for 11p n ill take that out too so they can't get it. Surely they can't just take your money!!

I had my letter yday ... they have accused me of living with someone - no names... when in fact I have been on my own with the 2 kids for the last 8 years & haven't even had a b/f for that length of time.....

Was worried sick (literally - has made me physically sick this morning) - until I thought to google their name - which brings up an interesting article:

Along with access to these threads - TG - at least I know I am NOT the "only" one now - far from it ... has made me feel a little better about it all.

Sent all the required docs to them recorded delivery today so hoping the end will be sooner rather than later & they will see what a stupid mistake they have made.
