I don't think I understand it properly either, but the meaning I am getting from it is that the parents and the children have different reasons for wanting to sue, they can't both sue (though I don't understand why not) and that the childrens' reasons have to take priority over the parents', so the parents can't.

But that's probably completely wrong! (Just thought I'd say hi too like beety! ) Pass the gin!

Right Bunglie - shall have a go at explaining this.

Basically sometimes there are two stages to civil cases if the reason that someone is suing is quite new/ground breaking, and not an established reason to sue. I.e. if you rear end my car, it is pretty well established that I could sue for that reason - there have been loads of cases in the last fifty or so years. But in these cases where somebody is suing the NHS/Social services for distress caused in investigating unsubstantiated allegations of abuse, this is not an established reason for suing i.e. people haven't successfully been able to do this before, and it is a new "cause of action". Because it is a new type of case, the first hurdle that the parents have had is to convince the court that they can, in principle, sue for the misconduct of the medics/social services. This is regardless of the merits of the case at this stage, and is just looking at whether in principle you can sue for medics/social services investigating wrong allegations of mistreatment of children.

When judges make decisions of this type, they can take into account the public good - i.e. public policy issues - and have to take competing interests into account. Judging by the Guardian article quote, the judge felt that although the parents had an interest in not being suject to a heavy handed investigation, the interest of the children should be given greater priority - i.e. that once an allegation of abuse had been made, even though the allegation may be unfair/unjustified, it was more important to protect the welfare of the children by carrying out a thorough investigation than to protect the feelings of the parents. I'll have to have a look at the case itself when I get the time to see if I can add anything else of interest!

Blimey, I'm offline for ten days and it all happens! So glad you had fantastic day with your ds and dd. Really heart-warming. Sounds like you are getting some very good advice about dealing with bl**dy solicitors and social services; injuction sounds like a particularly good idea. Did you say you had new solicitors? Can you just instruct them to go ahead and seek an injunction, or do you need information from the 'old' solicitors first?
I need to update you on my MP's reply... promise I will when I get a chance.

An update on the slightly confusing Guardian story from this morning - a mother, who cannot be named for legal reasons, has won permission to appeal in the House of Lords (in the Autimn sometime) for the right to sue Professor Southall for damages after he accused her of child abuse - details here .

GillW Is this what they call a 'test case'. Because if it is, I hate to say it, but the Judges don't seem to like this 'topic' and I think they will realise that the flood gates will open with regard to Southall.
I wonder why the GMC heard Southall's case before Meadow's, as Meadow's I thought was exposed first, am I wrong???
In anycase I shall be very interested to know what happens, do we know when it comes to court yet?
