Dear

I am a mother of two young children, the youngest of whom is 8 months old and fully breast fed. I have used your stores regularly in the past and have been happy with the service and products provided.

I was particularly delighted to use the breast feeding facilities at your new Mothercare store on Silverlink retail park in Wallsend and felt very impressed by the level of commitment shown to make the room relaxing and to promote breast feeding in a positive light.

However, when visiting the store on Monday 7th November 2005, I was disturbed to see a display of reduced price stage one Aptamil formula on the checkout. This completely contravenes the The Infant Formula and Follow-on Formula Regulations 1995 (which can be found at www.opsi.gov.uk/si/si1995/Uksi_19950077_en_1.htm).

To summarise the relevant information:
Restrictions on promotion of infant formulae
19. No person shall at any place where any infant formula is sold by retail?
(a) advertise any infant formula;
(b) make any special display of an infant formula designed to promote sales;
(c) give away?
(i) any infant formula as a free sample; or
(ii) any coupon which may be used to purchase an infant formula at a discount;
(d) promote the sale of an infant formula by means of premiums, special sales, loss- leaders or tie-in sales; or
(e) undertake any other promotional activity to induce the sale of an infant formula.

From my perspective, I feel that several of the above restrictions have been breached and would be very interested to hear your response on this matter.

It really makes no difference whether you agree with it or not. The fact is that it is illegal and Mothercare should be aware of this.

popsy that store hasnt been open long and the few times i have been in they seem to not really know what they are doing

I BET its someone not aware of the law and if you give them a ring they will disappear pretty sharpish

How about give them a ring now - they ought to remove the offer, which is initially what you want - then follow it up with a letter, which formalises your complaint?

I think it's a big problem in all Mcare stores, certainly IME. The staff in my local one seem very demotivated and uninformed. And the clothes stocking policy is deranged.

Yep, would do both. That way you make sure head office know of it - maybe you could ask them to make all their branches aware of it?

popsycal - well done on writing the letter and being such a staunch believer on this issue - let us know what the response is - I think Mothercare are going downhill as none of the staff in my local branch have a clue - they couldn't even tell me which car seat I need! I am sure it is as the others have said that it is someone in the store that doesn't know the law rather than mothercare per se, but Head Office should certainly be aware of the incident!

Agree on Mothercare staff probably not knowing what they were doing was wrong, they don't know their head from their arse in my local and talk over you at the till about nights out etc, v annoying.

Popsycal, I've complained twice about cut price formula in shops (Asda and Safeways) and both times swift action has been taken, so it's definitely worth your while to complain.

And before anyone accuses me of "getting so worked up about things like that" I get worked up about many things (State visit by the Chinese PM, anyone??). My mum always said two wrongs don't make a right and so I think it's important to make a difference whenever we can.

If that is the law, I really don't understand what it is trying to achieve.

And if anyone says "to prevent people choosing to formula feed instead of breastfeed", I will rofl.

Formula is not the same as alcohol, crack cocaine, cigarettes or 4x4's (sorry, have been on other thread.)

As the Daily Mail might say, "It's political correctness one mad!"

The rights and wrongs of the law are not what popsy is complaining about. It's the fact that mothercare is breaking the law
