Can the school do this??
My child has been permanently excluded for shouting at one teacher and supposedly pushing her way through another on her way out of the class. Witnesses who were there say she did not push this teacher and she also claims and swears on God and the bible that she didnt push this teacher.
The school still said in the meeting that there were 13 year 8s who wrote that she did push the teacher but they did not investigate the other students who were there that said she did not.
We have had many calls regarding her behaviour but not towards teachers mostly for breaking basic school rules like eating in the corridors, missing deadlines, and wearing two earring studs which is not allowed in her school.
In the meeting we were given an option to manage move but im not sure if this option is still available for her. How do we get this option because we feel it will be alot suitable than being expelled for something she did not do.

Also my child is black do you think this has anything to do with it?

Your misunderstanding the situation. Shes not disruptive in class, weve never gotten a call about her behaviour inside classrooms or towards teachers.

Yes i think it has actually changed since we moved from london and we did infact move to a non diverse area.

Your DD has not behaved well as she has already got to the stage where she is being offered a managed move which is a PEX in all but name and paperwork.

Exclusions are well regulated. There should be a panel to review this. You should get evidence from.both sides and governors have to consider the equalities act. The head must show the decision is not victimising the pupil on grounds of see, race, disability, religion, sexuality etc

If they uphold the schools decision you will have the right to appeal. The details will be on the letter.

@lilsgree i assume you have a letter from the school outlining next steps.
the governing body will need to review the exclusion so you could attend this meeting with your evidence and challenge the process as unfair because it’s based on an incomplete investigation. You could insist they properly investigate by taking all witness statements. However exclusion evidence is based on ‘the balance of probabilities’ not ‘proof beyond reasonable doubt’ so your DD may still be confirmed as excluded.
regardless, your DD doesn’t sound happy in this school and you don’t seem happy with it either, so moving her would be your best bet. However, if your DD has already been permanently excluded it will probably be too late for a managed move - but it is worth asking both the school and the council.

Look what i think everyone is refusing to understand is that she is not aggressive and she on my has issues following CERTAIN rules due to her mentality that it doesnt make any sense. Shes not an aggressive child, rude or anything like that.

There's no hope here. You say yourself that there is a long history of disruptive behaviour but then that she's such a good girl and just doesn't follow rules which she doesn't understand. Like no fighting and no pushing teachers.
You are the problem. Be prepared for the new school to exclude her as well. And be very scared about her life prospects.
Or do something and start parenting. Now.

She might be struggling with moving away from her friends and a familiar environment. Have you talked to her about how the move has affected her? Some kids are fine with change but others find it really hard.

She does attend church for your information and like i said when she gets in trouble she admits to it and tries to change her behaviour this year i have not gotten any new calls regarding her behaviour other than this incident. And also she doesn disrupt peoples learning or anyone. Please get your facts right before jumping to conclusion that she is a distraction to peopels education.

I think this actually may be the problem she did mention it alot and also her attachment to London shows it. When we refently banned her from going she cried for the whole day.

So she has been violent towards another child and been excluded for it previously but is apparently not aggressive. She doesn't know how to follow the school standards yet is completely trustworthy and would never lie to cover her own back. Come on OP. You're doing your child no favours here. Accept that there is an issue with your child's behaviour and start managing it better.

No i said she was being bullied by another child and that child ripped her ponytail. This fight was clearly just self defense. Im not saying shes completely trustworthy but knowing how religious my daughter is she would not lie on the bible and on God no matter how serious the offense.

No. She came home and told me weeks prior to the fight, when we went to the school they brushed it with very little investigation. Hence why i say this school is racist.

I doubt it’s because the school is racist and it’s probably to do with on going behaviour issues which aren’t improving.

being in a church choir doesn’t mean you’re not behaving badly at school
