AIBU to think these boys should have been incarcerated?

I've never started an AIBU before, but I'm genuinely really shocked. I'm just not sure how this sentence is justifiable. Their actions were premeditated and deliberate, they were carrying a knife and they filmed themselves. They're obviously a danger to women/girls, and probably to other boys too.

If anyone knows how and why this sentence might have come about, I'd be interested to hear it.

This sentence is actually disgusting. Those poor girls will live with what happened to them forever. These boys are free to commit aggravated rape again tomorrow. I wonder if anyone can raise an unjustly lenient challenge? 🤔

The girls were praised for coming forward - what a joke!

They went through hell, then steeled themselves to go through the hell of court, only to have their attackers virtually let off. Where is the deterrent factor in this for other boys? Where is justice for the girls?

How magnanimous of Judge Nicolas Rowland.
And what of the victims’ mothers? Where is the reporting on their reactions?

Boys who planned and executed gang rapes from age 13 will not magically be rehabilitated by 3 years of youth rehab.

That sentence is disgusting. Unlike most rape cases there is actual proof. And they are old enough to know better.

I don’t understand why the sentence is so lenient. Those poor girls.

I am surprised at the leniency of the sentence. The sentencing guidelines are here and it seems that a custodial sentence could have been imposed considering the aggravating factors yet the judge chose the YRO with ISS option instead: https://sentencingcouncil.org.uk/guidelines/sexual-offences-sentencing-children-and-young-people/?source=7511

I would not be surprised if the Home Sec appeals this one.

I've also submitted an unduly leainent sentence and sent an email to my local MP asking what is going on with the VAWG strategy as it just feels like lip service.

My heart breaks for these girls they get to walk but those two girls get a lifetime of trauma.there will be many women and girls up and down the country today feeling they have no protection, and after this joke of a sentence can we really blame them.

How awful. The judges words were sickening, all about making sure the boys are ok FFS.

I suspect we won't get the full sentencing remarks for a while. As you say, a custodial sentence could have been imposed, but as per the guidelines you link to a custodial sentence is really the absolute last resort and will try to be avoided:

"If a custodial sentence is imposed, the court must state its reasons for being satisfied that the offence is so serious that no other sanction would be appropriate and, in particular, why a YRO with ISS or fostering could not be justified."

I would guess significant reduction in sentence was applied due to the ages (the boys would have been 13 / 14 at the time they committed these crimes). Whether there are other mitigation factors like learning disabilities is unknown (at least I haven't seen anything).

How did you do this? The route I found asked for the name of the offender(s) which are obviously unknown in this case?

I don't get this train of thought though, if we can try 10 year olds for murder and lock them up then why would a 13/14 year old not be locked up for a premeditated gang rape & filming it?

So there is no deterrent for underage gang rape at all now. Other boys will undoubtedly copy them.
