Is Shabana Mahmood right or wrong to restrict asylum seeker's rights? In general?

It's a measured response rather than the knee jerk reaction we have been seeing lately from all and sundry. It's a vote winner/loser depending on your opinion but it's out there now. Will it happen? Rwanda didn't and neither have other schemes but this issue won't go away.

I was actually quite impressed. I thought the removal of family reunification would cause too much outrage on the back benches but she has gone even further.

@Octavia64 says a lot of what I think about migration and refugee status. Obviously living through war is hell and I think the UK's approach to Ukrainian women and children is good. I also hope they are able to go home to rebuild their country better.

I am much less enthusiastic about young male "refugees" from the Maghreb and Africa. The burden of proving their peril should be much higher.

I agree @BeefFriedChips . But no Conservative politician, even a POC, could have proposed what Shabana Mahmoud is expected to announce tomorrow without facing a barrage of racism allegations. Priti Patel and Suella Braverman would have been eviscerated on MN if they had drafted the same proposals.

I suspect a lot of labour MPs will have decided that they are too busy to do the interview rounds tomorrow!.

It's irrelevant what Labour proposes. The issue is the inevitability of any new laws being challenged in the courts on human rights grounds. Such legal actions have a very high chance of success at present. Until that issue is addressed then it's just political grandstanding.

AIUI the courts can't overturn primary legislation. They can issue a declaration of incompatibility with the ECHR (I have no idea what the likelihood is of that here) but the UK doesn't actually have to change the law as a result. We've previously had declarations of incompatibility (e.g. re not allowing prisoners to vote) which we ignored for years.

We can't deport anyone now, imagine trying to return someone to Afganistan for example after this proposed 2 years - who decides it's safe?, you can bet the person you are trying to deport won't think it's safe and so the merry-go-round round of HR claims and court appeals begin.

Surely, if you are granted asylum and then a few years later return for holidays in the place you said you were fleeing from, that place must now be safe to return to permanently?

This is my opinion as the descendant of legal immigrants who came to the UK at the request of the then post war government's.

That's correct. Some of the "terrified" afghan interpreters have been going back for holidays.

The concern is, with cuts expected via spending reviews on all Gov depts, is how on earth are they going to be able to regularly review each persons claim every few years? Unless it’s just purely a ‘how is the situation in x country right now’ and then that’s everyone reviewed. Only way to do it. Makes sense though if the situation changes in a country, why not say you can return. The reality is, I doubt many people will return.

What is needed, is faster processing of asylum claim, and swift removal of those who aren’t successful. With all the appeals / legal routes it’s pretty difficult to remove many people, and of course some will be back the following week.
