To think that if you commit a male crime, you should do male time, even if you identify as a woman?

I know this is a sensitive topic but I’ve been thinking about how justice systems handle trans women who commit serious crimes, especially violent or sexual offences, and whether it’s fair to house them in women’s prisons. To me, if you were born male and commit a crime typically associated with male offenders, particularly one involving violence against women, it seems like common sense that you should serve time in a male facility. Identity doesn’t erase biology or risk in those cases.

Yes it absolutely is. But cannot override patients consent. If they want a female doctor then a biological female doctor, unless not possible and that is fully explained with options, is who treats them.

I mean DU did play on the male hockey teams. So he can’t have thought he was female otherwise he’d have been demanding to play on the female teams. The fact he totally presented as male until very recently shows he knows he’s male. The fact is he told HR he would be using the female changing rooms shows he knows he’s male was male. No women ever went to HR and said “I’m going to be using the female changing rooms if that’s ok”. All evidence points to the fact he knows fine well he’s male and I’m not sure why some posters are so determined to insist he knows he’s female.

I can't see what there is to argue about.
If you commit a crime and have a Y chromosome you go to a men's prison.
If you have a Y chromosome , even if you've had your penis removed and I'll feel vulnerable in a men's prison, there is a simple solution.
Don't commit any crimes.
I can't understand why criminal men, with or without penises, have anything to do with women or women's prisons

If he doesn't understand that his perception of himself is of fuck all relevance to women, who see him as the male doctor he is, he shouldn't be practising medicine. Because an excellent doctor centres the patient, not themselves.

I feel a bit sorry for those trans people who were misled into believing they had the right to access spaces designated for the opposite sex. In my opinion, they should look into suing those who lied to them and misrepresented the law. Unfortunately, they now have to abide by the law and use the facilities designated for their sex. That may upset them, but they need to deal with it.

If you are born male and sexualy assault a female you should be locked up gen pop in an all male prison. Where the men can treat you like their bitch the way you deserve. You should not get to claim being a woman to avoid the punishment for the crime you committed using the dick you claim not to want. If they were perfectly happy using it to abuse a woman then they can't claim to be a woman to get a lighter punishment which places them in a prison with women which equals more potential victims.

That wasn't necessary because all sane people know what female means. The Supreme Court doesn't draft its judgments pitched at the level of loonies. It assumes a certain level of sanity and intelligence in its readers.

So according to @Tandora we are now in a situation where if an elderly woman, a woman with learning difficulties or a woman who doesn't have English as a first language is raped they should take the time to find the right words so as not to offend a male doctor who thinks they are a woman.

Dr Upton IS MALE. None of this word tangle stuff about being registered male at birth as though a) it may have been a mistake or (b) his sex could have changed between birth and now. Dr Upton has been male since conception, since the sperm found the egg and fertilised it and he will remain Male for the entirety of his life with no possibility of that changing.

Dr Upton can wear whatever clothes he wants, can go by any name he likes and can choose to live his personal life however he wants to but he is not now, has not even been and will not ever be female.

Dr Upton is trusted by patients, all of whom will be vulnerable to some extent if only because at the moment that they are being treated they are unwell or injured which is a position of vulnerability, to deliver personal medical care. What kind of person, knowing that they are dealing with a person in a vulnerable state, chooses to directly contravene their wishes and attempt to deceive them? He has admitted in court that he would do that. He explicitly stated that if a patient asked for a female doctor to conduct an intimate examination he would ignore that request and continue as he ‘feels’ like he is female. Regardless of how he feels he knows the biological truth, he knows what his sex is, he knows that people can tell he is male from his appearance so he knows he would cause distress, and honestly if he is in such denial of the truth and evidence then he should not be deemed competent to treat patients.
