Should she replace it? Part 3

1000 replies

Langarg · 02/01/2025 19:09

I can’t believe we have a part 3 🤣 this has provided some lighthearted entertainment at a time where I’m feeling really let down by someone I considered a good friend. So thank you! I have posted an update on thread 2, will post it here also.

I have sent the following text message ‘Having reflected on what you have said, how the airwrap was lost/broken or otherwise is irrelevant. I considered asking you for pictures of the broken airwrap or asking to speak to your sister to ask her what happened but it will get us nowhere. All that matters is I am down a Dyson airwrap and I want a new replacement. You’ll need to either transfer me the £399 tonight to pay for this or purchase it yourself from boots and send me the email receipt this evening. You can then sort out with your sister whether she is going to contribute to the cost of it. We can then put this behind us’

I have no interest in maintaining the friendship after this for obvious reasons. I am worried that she’s seen the thread (how can she not have 🤣) and knows this fine well so will have no intention of replacing it sadly.

I don’t think I’ll ever get the truth (was there even a wedding at this rate?! 🤣) all that matters to me now is getting a replacement airwrap!!!!

Any update langarg?

dapsnotplimsolls · 04/01/2025 16:30

I'm sure OP will be back when we get to page 40 ...

fairytailcat · 04/01/2025 16:30

Omg there's gonna be thread 4

Petlover9 · 04/01/2025 17:13

Joelle84 · 04/01/2025 12:06

Were going to need a part 4….

We are all going to need large G&T's and cake, lots of cake ! I so hope the OP gets the Small Claims Court papers filed, and I would like to be a fly on the wall when CF opens the letter.

Petlover9 · 04/01/2025 17:22

AngelicKaty · 04/01/2025 13:30

Why do you regard making a court claim as "drama"? Have you ever made a claim? (It's usually people who haven't done so who are scared of doing so and think it's a "drama").
Of course there are things to be considered before starting a claim - primarily the respondent's financial position and ability to pay as it's disheartening to secure a CCJ but still not get paid what you're owed* - but if CF is working, the court could make an attachment of earnings order, or if not, most people have assets for EAs to seize to "persuade" them to pay up. If CF is so hard up, she would need to provide a financial statement (with supporting evidence) to the court for the judge to allow her to pay in installments.
OP would be claiming £500 plus court fees and Statutory Interest at 8% - so it would absolutely be in CF's interest to pay up before the claim gets to court as it would cost her less (hopefully the Letter Before Action would make her realise this).
It's worth OP getting a CCJ against CF as a matter of principle - even if she can't get the money out of her - because it will remain on CF's credit file until the debt is settled and affect her ability to borrow money (store credit, loans, mortgage, etc.). *This would be sufficient revenge for me, even if CF didn't pay up.

Edited

AngelicKaty, I totally agree with this^. It was an expensive item for the OP to buy and CF Friend has told so many lies, the Court letter should teach her that is not a playground spat over a skipping rope, but something valuable.

For the love of God, this ‘saga’ doesn’t merit a thread four. How much more is there to say?!

CrowleyKitten · 04/01/2025 17:34

InkHeart2024 · 03/01/2025 09:39

Honestly I'd suck it up and buy a new one myself today (if you have the money available) and chase her for it through small claims as otherwise she won't buy it today and you'll be without an airwrap and having to replace it at full price eventually.

yeah, if you can afford to do that, it seems the best bet.

We haven't cast the musical yet.

menopausalfart · 04/01/2025 17:39

It's not over 'till it's over. Starship or Kravitz, doesn't really matter.

AlexisP90 · 04/01/2025 17:46

I need to see the conclusion!! Bring on part 4

Does anyone have a link to the alleged Boots offer at £400? I ordered an Air Wrap last night for my wife, direct from Dyson, for £480. Google couldn't find it for less anywhere.

OP: My thoughts are that you should now leave it.

I’m not a lawyer, but I believe the 'contract' will be with the person you lent it to. Chasing the sister would only complicate things, and possibly indicate that you no longer require recompense from the original lendee and have accepted transfer of the contractual obligation to a third party. Very dangerous.

And under no circumstances meet anyone, or go to anyone's house. You may be accused of intimidation.

It's very simple: Person A (you) lent an item to Person B (the alleged CF), and you can prove you did so. It was clear that you expected it back; it was not a gift, wedding or otherwise.

Person B, despite multiple reasonable requests, has not returned the item.

If it were me, I would buy myself a new one now, then commence a small claim for the financial loss.

Waiting for a small claims order for her to go out and buy you one would be absurd. It will take months, and then you have to chase for her to actually buy the right thing.

Keep it simple, and remove any possibility of your receiving second hand junk. A straight financial claim, evidenced by a dated receipt, plus costs. It’s really easy. If she defaults on a financial award, send in bailiffs.

Good luck!

Mark

Edited

OP, you really should listen to Mark. Negotiation / inquiry period is over. Time to go the nuclear option.

@IridiumSky My Airwrap was a Christmas gift from my husband a few years ago (he saw a demo at John Lewis while shopping for Christmas gifts) and it is the best gifts he's ever found (with no help from others)!

WellThatsNice · 04/01/2025 17:54

Let’s hope the CF friend is inspired to do the right thing after no doubt reading all the comments here and all across social media 😅

MrsPeregrine · 04/01/2025 18:32

Absolutely amazed at the absolute cheak of some people. What kind of a person must you be to ask to borrow an expensive item for a friend and then not give it back because you want to keep it for yourself? Some people have no self respect.

Ljmell · 04/01/2025 18:35

..

Should she replace it? Part 3
FizzyBisto · 04/01/2025 18:35

I don't know whether to go for the role of the CF; or should I try for a speaking part instead?

Itsgottobeme · 04/01/2025 19:16

I'm sorry but Dyson give bigger CF influencers Dyson Airwraps for much less. They need to cough up with a "#gifted" (vom)one.

TreacleTarcleSparkle · 04/01/2025 19:24

First of all this ‘friend’ has made me MAD .. I’m so angry on your behalf OP and please look into small claims court or start with the letter to her to play ‘devils advocate’ as a one last chance it her coughing up what you’re rightfully owed. I mean what an absolute pig of a ‘friend’?? How does she even make/get this many friends over the years to be able to beg/ ‘borrow’ / steal from in the first place?
If it was a decade or so ago and in the USA this would be a perfect scenario and solution for you to go on Judge Judy.. Judy would sort this horror woman out!!

On a side note .. I love all things hair and have regular bleach highlights and great lengths hair extensions (hence always overdrawn !) i’ve bought so many ‘over hyped ‘ hair devices over the years to only be disappointed and at a loss monetary wise .. what is SO good about the dyson airwrap to justify the £500 original RRP price tag?
I don’t like the poker straightened hair styles (reminds me of ironed curtains crossed with cousin It from Addams family) i love the polished freshly blow dried salon look and the beach boho long loose curls look (Elle Mcpherson kinda hair ) does this Dyson achieve looks like this? Or is it about drying the hair super fast ? Has anyone that’s invested in one regretted spending all that money and it just sits away in a drawer it has it been a bit of a ‘game changer’ ? I’ve always wondered (well occasionally)over last couple of years but since reading this thread I’m ‘umming and argghing ‘ again about pros and cons and is it worth it ?
