To refuse to give my full date of birth to a delivery driver for my online food shop

I just placed an order for some groceries and provided photo ID on delivery - Oyster 60 plus photo card. The delivery driver refused to leave the shopping, there was one bottle of wine, as I refused to give my full date of birth. No wonder we have so much fraud!

This is actually incorrect, my friend works at polling stations (and has done since we left school) and she isn’t a central government employee and it isn’t always in her home town either!

The poor delivery driver was just doing his job, I am sure he couldn’t care less about your DOB but had to ask to enable the delivery!

It will be because they need to enter it on their system to prove they are selling alcohol responsibly, it probably won't let them proceed without entering it, I doubt it's because they want to steal your identity, people that do that don't delivery groceries.

Driver should be sacked and re-educated on discrimination.

The equality act is there to prevent age discrimination. Whilst there is limited exemption for alcohol sales this only applies where a person appears to be under 18. It also allows challenge 21 and 25 schemes. Refusing to deliver an order to someone over 60 because they decline to share personal information is a discriminatory act. With the protected characteristic being age.

For all those saying it's acceptable because his employer told him to. Would it be OK if his employer told him to discriminate on other protected characteristics such as race, gender, sexuality, pregnancy or disability?

I'm not sure how you think a DoB has nothing to do with age. But, let's assume it wasn't. On that basis what was the driver's basis for processing the customers data?

@ECGG that was probably just what they use.
They could use a code word that people have to confirm before a delivery is handed over. Or the last 4 digits of your phone number. Or something else random.
DOB is the easiest because most people can usually remember there own birthday.

So if he’d left the shopping and gone back to his employer without a correct audit trail the likelihood is that he would be reprimanded. Would you want to be responsible for putting someone’s livelihood in jeopardy just because he asked for your date of birth?

you’re both as unreasonable as eachother 🤣 I’m sure he could have just whacked in any DOB as I’m sure mine do cos they never actually ask to see my id. But in the same breath if he’s asked u (maybe taking job too seriously, maybe being awkward) you could have just told him…

also I worked in the last elections as a poll clerk and I’m a beautician with a salon defo no council employee 🤣

I've never been asked for my dob or ID by a delivery driver? Mind you, they must know it as I'm registered on their website....

You don't get added in shops either- it's 'looks over 25' - they do a visual check.

Bur I wouldn't refuse if they did. I'm over 60 too.

i work as legal counsel for large retail chain. Just negotiated delivery contract and it is a key requirement that they obtain date of birth from all customers to ensure compliance with licensing laws. So whether you look 15 or 100, to cover all parties’ legal requirements, they are going to ask for dob

This thread is crazy. If you look obviously over 25 - let's say you are 70, and someone dropping deliveries off asks for your date of birth and you don't want to give the real one - just make a plausible one up. They have no legitimate grounds to ask to see ID. The law is that you cannot sell items such as knives, alcohol to under 18s. If there is no risk you are under 18 and Supermarkets operate an under 25 policy, there really should be no issue. If you look under 25 and are asked, then you need to show photo ID; and both passports and driving licences will have your dob, so you just have to lump it. Good grief.

That is your key contractual requirement. The law just says you have to be over 18, not that anyone has to have proof of your date of birth. Hence it is pretty silly to ask a 50 year old, 70 year old for photo ID when it is obvious they are not under 25. So really they could just give any plausible date of birth if asked to make it go away.

I think it would help supermarkets to understand that people can be sensitive about their personal data as all you ever here about on the news is money being stolen because of a loss of personal data. So it would be good for people to start behaving practically.

This is the problem with retailers. You are asked for your date of birth all over the place - I have a set fake one that I give out which is plausible but not my real details, which I reserve for when really required. Who knows when these supermarkets etc. will be hacked, lose your data and next thing you know your personal details are on the dark web. No, no and no. It would help if their legal departments exercised some common sense and stopped gold plating the law.

No they’re not. They’re mostly made up of temps, who sign up to do polling day. I used to do it in my 20s. Anyone can sign up to do it and receive a day’s pay.

the driver has to take your correct DOB otherwise they are not allowed to give you your order.
Your DOB is linked to your account. Showing ID is not enough in this situation.
You were being totally unreasonable!
