To think this shouldn't result in a prison sentence

I've read that idiot who showed the picture of that poor little boy at the football match is facing jail. Showing that picture was incredibly cruel, nasty, spiteful and many other things. That poor boy suffered with cancer and his family lost him so young.
However I do not believe this man should go to jail for showing the image. He rightfully deserves to be named and shamed, cautioned, possibly banned from future matches. But I don't understand why he should be going to prison over it.

I agree with you OP. He's been identified by the media, lost his job and will likely face a long an from football grounds. Incredibly stupid, hurtful and rotten thing to do but if we start locking people up every time they do vile, nasty things, we'd soon run out of prison space.

Or they might think twice before doing them……

I met up with a friend this week, she knows his Mum. The whole village has turned against him, he daren't leave the house and has been barred from all the pubs and bars, it's a lively place for young people with many bars.

Most contracts have a “bringing the employer into disrepute” clause these days. Mine certainly does. Gross misconduct.

If he has been there less than two years they don't have to give a reason at all.

I agree. It was a really nasty thing to do, but people do nasty things every day and get away with it.

However I have a fairly extreme view on jail, that you should only be in jail if you do something violent or dangerous - so murder/manslaughter/death by dangerous driving, arson and rape/sexual assault. Everyone else should be receiving more creative community sentences (eg the person who cut down that tree should be required to spend every weekend for a year planting trees).

Maybe the guy who did this could be required to spend time with Ofcom learning about online safety.

Sounds like a decent enough punishment. Although now, of course, he's unemployed and the taxpayer has to support him. And he's more likely to fall into more crime if he's unemployed.

Goodness... what he did WAS horrible. Not "just" because of the disrespect he showed to the lad and how this must have hurt his family. It also seems like that would primarily be a civil matter (and potentially a very minor criminal one). But I am not from the UK , so I probably have different legal framework in mind.

But it seems (to me) as if he was also trying to provoke a violent reaction, which may have caused a very dangerous situation. Which obviosuly should not be condoned. A football ban would seem perfectly reasonable (to me). As would community service (not in contact with vulnerable adult or children!)

But does he deserve to have his life ruined? Allienated from his community, career destroyed etc? Maybe even sent to prison?
Shunning people probably doesn´t improve their chances of integrating in society and living a normal, non-criminal life. And the same also applies incarceration...

It seems epecially disproportionate when one considers that people found guilty of SA, battery or serious financial crimes often face less consequences!

For many employers a criminal conviction (which he now has as a result of pleading guilty) is gross misconduct.
